신상공개제도 대상자의 제도인식에 관한 탐색적 연구: 보호관찰중인 신상공개 대상자를 중심으로

In Korea, registration and notification policy on sex offenders are among the mostly widely discussed and debated policies with electronic monitoring system for sex offenders. Even though public’s view and perception on the notification policy are described as valuable and important for public safety and the right to know for the public, there is lack of data regarding how sex offenders perceive and value this policy which they are subject to. Previous studies heavily focus on the constitutional concern on the violation of individual privacy and legal issues such as double jeopardy, cruel and unusual punishment, etc. Studies on the perceptions and views on notification policy mainly conducted towards the public,and previous studies rarely focus on the sex offenders’ view and perception on the policy. The understanding of the policy and positive attitude toward those regulations are crucial for the success of the policy. The present study proposed to address this gap through an examination of the sex offenders’ opinion on the notification policy and what factors contribute to the perception of public notification law among sex offenders subject to notification policy. Data for the present study are collected from survey administered to convicted sex offenders who are on probation currently and subject to notification policy. Individuals who have prior history of sex crime are more likely to have negative perception on the community notification. In addition, individuals who had negative experiences during investigation and trial process are more likely to have negative perception on community notification. Unexpectedly however, negative experiences within neighborhood due to the notification such as threatening from neighbors and moving out of neighborhood do not effect on one’s negative perception on the community notification.
