대형마트 및 기업형슈퍼마켓 영업일시(營業日時) 규제에 관한 법적 고찰

「유통산업발전법」 제12조의2에 따라 대형마트와 기업형슈퍼마켓(이하 “대형마트등”이라 한다)의 영업일시(營業日時)를 제한하는 제도가 2012년 1월 17일부터 도입ㆍ시행중이다. 이와 관련해서 2012년 2월 한국체인스토어협회는 대형마트등의 영업의 자유와 소비자의 선택권 침해를 이유로 「유통산업발전법」 제12조의2에 대한 헌법소원을 제기하였고, 아직 심리중에 있다. 2013년 1월 「유통산업발전법」은 대형마트등에 대해 더욱 강한 영업일시규제가 가능하게 개정하였으며, 이 개정법조항에 대해 이번에는 대형마트등에 물건을 납품하는 사업자등이 헌법소원을 제기하려는 움직임을 보이고 있다. 그럼에도 불구하고 한편으로 국회에는 영업일시규제를 더 강화하기 위한 「유통산업발전법」 개정안이 여럿 발의되어 있다. 전통시장과 중소상인을 중심으로 이루어져 왔던 중소유통업계는 유통구조 및 소비행태의 변화로 붕괴위기에 놓이게 되었고, 이러한 상황은 대형마트등의 급격한 증가와 맞물리면서 더욱 촉발되었다. 최근에 와서 이러한 문제는 우리사회의 구조적 문제로 확대되어 중소상인 보호 및 대기업 규제에 대한 요구로 이어지기에 이르렀다. 유통분야에서 대형마트등의 영업일시를 제한하는 「유통산업발전법」 제12조의2 역시 이러한 상황의 산물이라 할 수 있다. 「유통산업발전법」 제12조의2는 대형마트등에 대한 영업일시규제권을 지방자치단체의 장에게 부여하고, 필요한 사항을 조례로 정하도록 규정하였다. 이에 따라 각 지방자치단체들은 영업일시 제한에 관한 조례를 제정하였고, 각 지자체장은 대형마트등에게 휴무일과 영업시간을 제한하는 처분을 하였다. 대형마트등이 처분의 위법을 이유로 제기한 취소소송에서 영업일시제한 처분은 위법한 조례에 근거하여 이루어진 처분으로 위법이라고 판단되었고, 이 판결로 영업일시규제에 대해 약간은 주춤하는 분위기가 조성되기도 하였다. 그러나 이 판결은 대형마트등에 대한 영업일시규제 자체에 대한 판단을 하였던 것은 아니라는 점에서 영업일시규제의 허용성과 관련된 쟁점은 발견하기 어렵다. 다만, 조례제정권의 한계논의에 초점을 두고 조례의 위법과 그에 근거한 처분의 위법을 판단하고 있다는 점에서 행정법적 쟁점에 대해서는 분석ㆍ평가할 필요성이 있다. 아직까지 「유통산업발전법」상 영업일시 제한의 합헌성에 대한 판단이 진행중이고, 사회적으로도 이에 대한 찬반대립이 엇갈리는 분위기라는 점에서 영업일시규제에 대한 논의의 실익은 여전히 존재한다. 본 논문에서는 대형마트등에 대한 영업일시 규제제도가 헌법상 허용되는 것인지 여부를 비례원칙을 적용하여 판단하였다. 제로섬(zero-sum)적 성격을 강하게 가지고 있는 유통산업에서 대형마트등의 영업일시를 제한하는 경우 중소상인과 전통시장 보호에 영향을 미칠 수는 있다. 그러나 중소유통산업이 위축되고 있는 원인이 대형마트등에 한정되지 아니하고 여러 가지 다른 원인에 기인한다는 점에서 보면 대형마트등에 대한 영업규제를 강화하는 것이 과연 적합한 수단인가에 대해서는 면밀한 검토가 이루어져야 한다. 본 논문은 대형마트 영업일시규제와 관련되는 법익인 건전한 유통질서 확립, 근로자의 건강권, 상생발전(相生發展)과 대형마트 사업자의 영업의 자유 및 소비자 보호 문제를 종합적으로 고려하는 경우 대형마트등에 대한 영업일시 규제는 헌법에 위반될 가능성이 높다는 견해를 제시하고 있다. 유통산업 규제는 경제규제의 역사와 마찬가지로 시대별ㆍ국가별 환경에 따라 지속적으로 변화할 수밖에 없다. 자영업 종사자 비중이 높은 우리나라의 사회적 구조에 최근의 경제민주화 논의가 더해지면, 정치적 관점이 참작될 수밖에 없는 헌법재판에서 「유통산업발전법」상 영업일시 규제제도에 대해 위헌결정을 내리기는 쉽지 않을 수 있다. 그러나 대형마트등, 중소상인, 소비자 모두를 고려하면서도 유통산업의 경쟁력을 활성화시킬 수 있는 정책이 과연 어떤 것인가에 대해서는 신중히 검토되어야 한다. 본 논문은 영업일시 규제와 관련된 일련의 논의들을 통해 유통분야에서의 정책방향을 설정하는 데 기여하는 것을 목적으로 한다.
Abstract
Regulations restricting the business hours of Major Supermarkets and Super Supermarkets (hereafter referred to as ‘Major Supermarkets’) have been introduced through the 「Distribution Industry Development Act」. In February of 2012, the Korea Chain Store Association filed a constitutional complaint against Article 12-2 of the 「Distribution Industry Development Act」 on the grounds that it violates business freedom of Major Supermarkets and in addition infringed consumer rights. In January of 2013, amendments were made to the 「Distribution Industry Development Act」 to tighten operators’ business hour regulations, and in response Major Supermarkets, along with their suppliers are preparing to file a constitutional appeal against the amendment. Nevertheless, the National Assembly has initiated amendments to the 「Distribution Industry Development Act」 in order to strengthen Major Supermarkets business hour restrictions and regulations. Changes in the Distribution Industry structure and consumption patterns has lead the Small Distributor Industry, consisting primarily of Traditional Markets and Small Merchants, to the verge of collapse. This situation has magnified due to the sudden increase in the number of Major Supermarkets. Ultimately, this problem expanded into that of societal structure instigating the demand for the protection of small merchants and regulations of large enterprises, thus Article 12-2 of the 「Distribution Industry Development Act」 restricting business hours of Major Supermarkets is the product of such demands within the distribution industry. Article 12-2 of the 「Distribution Industry Development Act」 amended on the 17th of January 2012, conceded regulatory authority to the head of local governments and in addition ordinances were to be enacted according to its requirements in applying business hour regulations. Local governments established ordinances and according to the regulations each Mayor authorized restrictive measures regarding business hours and designating mandatory off-days for Major Supermarkets. Major Supermarkets filed a revocation litigation based on the illegitimacy of dispositions restricting business hours and as a result of the success of this lawsuit, the attitude towards the regulations were slightly mollified. However, this result does not judge the legality of restricting business hours of Major Supermarkets. Rather, this adjudication focuses on the discussion of the limitations of ordinance enactment authority through this regards the legality of ordinance and its resulting violation of dispositions, thus there is a need to evaluate the administrative legal issues. In addition, as the issue of the litigation was not an assessment of the system itself, the actual profitability of the discussing the constitutionality of business hour restrictions through the 「Distribution Industry Development Act」 is indisputable. This paper applies the proportionality principle to determine whether restricting business hours of Major Supermarkets is constitutionally permissible. Considering the zero-sum standing of the distribution industry, restricting the business hours of Major Supermarket could influence the protection of Small Merchants and the Traditional Markets. However, considering that the regression of the small distributor industry is not only attributed to Major Supermarkets but a combination of other factors, close evaluation is required to determine whether strengthening the restrictions of Major Supermarkets can be considered a suitable method. Comprehensively considering the legal interests relating to business hour restrictions of Major Supermarkets such as the transparent establishment of distribution, laborers’ rights, mutually beneficial development, business rights of Major Supermarkets, and consumer protection, this paper presents the view that restricting the business hours of Major Supermarkets holds high potential in violating constitutional law. Comparable to economic regulations, distribution industry regulations are largely affected by the environment in which they are applied. In a societal structure with a majority of self-employed workers, increase of discussions to democratize the economy and in the constitutional court where political bias is inevitable, making a decision on unconstitutionality regarding business hour regulations of the 「Distribution Industry Development Act」 cannot be simple. However, considering all parties including Major Supermarkets, Small Merchants, and consumers, it is necessary to examine what policy can further the competitiveness of the distribution industry. This paper aims to contribute to the establishment of the policy direction of the distribution sector through the issues mentioned above.
