사회적기업의 활성화를 위한 법제개선에 관한 소고

초록
최근 세계는 공통적으로 빈부격차의 심화로 인한 계층간의 갈등, 고령화로 인한 사회서비스수요의 증가, 지속적 불황으로 인한 정부의 재정능력감소 등의 문제를 맞이하고 있다. 이러한 분야는 전통적으로 정부가 담당하고 해결해야 하는 분야라고 인식되어 왔으나, 최근에는 공적분야가 아닌 사적분야, 특히 기업을 통해 이와 같은 사회적 과제를 해결하려는시도가 이루어지고 있다. 우리나라에서도 공공근로사업이나 「국민 기초생활 보장법」에 따른 자활사업 등과 같은정부 주도사업의 한계 내지 문제점을 인식하고, 민간기업이 주도하는 사회적기업에 대한육성방안의 논의가 시작되었다. 그리고 이러한 논의의 결과 2007년 1월 3일 「사회적기업육성법」이 제정되었다. 그러나 우리나라는 정부가 사회적기업의 인건비를 직접 지원하는 방식으로 사회적기업의 육성을 도모하고 있으며, 이러한 지원방식은 정부의 지원이 중단되면 사회적기업의 운영도 중단되는 문제점을 발생시키고 있다. 따라서 사회적기업의 활성화를 위해서는 현재와같이 직접적인 인건비를 지급하는 방식의 지원방식을 벗어나서 사회적기업이 지속가능한 성장을 이룰 수 있는 다양한 형태의 지원이 필요할 것이며, 이를 위해 현재의 사회적기업육성법에 대한 검토가 필요할 것이다. 또한 정부의 지원 외에도 사회적기업의 자생력을 제고하기 위해 사회적기업간의 연대나지역사회와의 연대를 강화하기 위한 방안도 마련되어야 할 것이다.
Abstract
A social enterprise is a business with primarily social objectives whose surpluses are principally reinvested for that purpose in the business or in the community, rather than being driven by the need to maximise profit for shareholders and owners. In order to solve the social problem needs the financial support of government but social enterprise that supported at some stage can solve the social problem continually through make a profit. It is the most important reason why we have to solve the social problem through social enterprise In Korea, the social enterprise promote act was enacted on 2007. However There were quite a few problems. Korea government promote the growth of social enterprise by direct support such as personnel expenses. So To stop funding from government drove social enterprise into bankruptcy Thus It needs to various support for revitalization of the social enterprise such as management support, changeover to registration system, introduction of mutual aid system, and so on. Furthermore It needs a system that can cooperate between social enterprises.
