흠흠신서와 평등권에 대한 담론

초록
흠흠신서는 다산 정약용(1762-1836)의 대표적 저작의 하나로 중국과 한국의 형사재판에대한 다산의 주석과 비평이 포함되어 있고 국가에서 편찬한 자료가 아닌 다산 개인이 조선과 중국의 법률서적, 문학작품 등 폭넓은 자료를 섭렵하여 편찬한 저작물이라는 데에 큰 의의가 있다. 흠흠신서의 구성과 내용체계를 살펴보고 헌법의 구성원리인 평등권에 대해서고찰하였다. 상대적 평등원리를 중심으로 살펴보고, 오펜하임(Felix Oppenheim)의 평등이론을 간략하게 기술하였다. 그리고 다산의 정치적 평등사상과 경제적 평등사상을 살펴보고흠흠신서 전면에 내포된 자의성금지에 대해서도 언급하였다. 다산은 당시 사람의 생명을다루는 사건에 대한 재판이 지극히 자의적으로 이루어지고 있었음을 개탄하고 재판하는 사람은 경(敬)과 애(愛)로써 백성을 흠휼히 하는 마음으로 재판에 임해야 한다고 했다. 이렇듯 흠흠신서를 간행하게 된 다산의 도덕성과 인간존중사상은 평등사상의 기초가 될 뿐만 아니라 흠흠신서의 내용에 면면히 흐르는 상대적 평등관을 도출할 수 있다.
Abstract
HeumHeumsinseo is the one of famous wrtings by Yak Yong Jung(1762-1836), Dasan, contained of his annotation, review on criminal trials of China and Korea. It is important that HeumHeumsinseo is purely individual writing added various contents of legal books and literature in the China or Choson. I considered the component and content system on HeumHeumsinseo and composition principle of constitution, equal rights. Also I briefly studied relatively equal principle and equal theory supported by Felix Oppenheim. And I considered political and economical equal thoughts on Dasan,mentioned arbitariness prohibition theory on HeumHeumsinseo. Dasan emphasis on the love and respect of confucianism, huminity, morals basis on equal thoughts. Though this working, I deducted from HeumHeumsinseo a relatively equal perspectives.
