초록
1988년에 출범한 제1기 헌법재판소는 우리 헌법재판의 초석을 단단히 놓은 재판부로 긍정적 평가를 받는다. 제1기 헌법재판소 재판관들 중 이시윤 헌법재판관의 판결성향을 분석함을 본 연구의 목적으로 삼는다. 이를 위해 우선 이시윤 재판관이 헌법재판관이 되기 전에어떠한 인생행로를 걸어왔는지를 살펴보고, 이시윤 재판관이 관여했던 주요결정 중에서 그의 판결성향을 잘 보여준다고 생각되는 결정들을 정치, 경제, 사회, 형사의 네 분야에서 각각 하나씩 선별하여 그에 대한 정성분석을 실시하며, 또한 동시에 그가 헌법재판관으로서재임기간에 참여했던 전체 결정들에 대한 통계분석에 근거해 그의 판결성향을 살펴보는 정량분석을 시도해 볼 것이다. 그런데, 이러한 대표판결에 대한 정성분석에는 사법적극주의와 사법소극주의, 사법진보주의와 사법보수주의, 재판관의 의견이 특히 사회적․경제적 소수자 및 약자의 권리를 신장시키는데 주안점을 둔 것인지 여부, 재판관이 판결에서 청구인의 기본권 보장을 확대하려는 입장에 섰는지 아니면 청구인의 기본권 제한을 옹호하려는 입장에 섰는지 여부의 네 가지 분석틀을 사용할 것이다. 그리고 정량분석에서는 주로 사법적극주의와 사법소극주의의 분석틀을 사용할 것이다.
Abstract
The first-term Korean Constitutional Court is esteemed as a bench that established a firm cornerstone for the constitutional adjudication in Korea. The aim of this paper is to analyze the judicial inclination of Justice Si-Yoon Lee in the first-term Korean Constitutional Court. Justice Lee had been a well-renowned judge as well as a law professor teaching civil procedure before he was appointed as a Justice of Korean Constitutional Court by the Chief Justice of the Korean Supreme Court. To achieve this aim, this paper will examine the life path of Justice Lee before he became a Justice at first. Then, it will qualitatively analyze his opinions as a Justice in the Korean Constitutional Court in the four major cases representing political, economic, social and criminal fields. Finally, this paper will quantitatively analyze his whole opinions based on the statistics. For these analyses, the analytical frames such as ‘judicial activism v. judicial passivism’ will be used.
