A Comparison between Marine and Island Related Laws and Integrated Management Plan

This study analyzes integrated managements involved in marine and island laws by comparison. The laws operated at present are a total of 14, and their main purpose involves environmental preservation, state safety and developing acceleration. 11 of 14 laws deal with the preservation of marine and island environment. Until recently, the environmental preservation was controled by previous laws. Among those 14 laws, the restriction of acts, limited coming and going, fundamental and management plans and research on actual conditions are mutually similar. In addition, although the application of each law varies, they all have the similar purpose. In the 21th century, marine policy is closely linked with the problem of maximizing the profit of a native state. In order to cope with the elaborate marine polices of other foreign countries and to advance its own, integrated management and enacting new laws are essential. In particular, the restriction of acts, limited coming and going, research formats to natural environment, relation to other laws, and appointment of use, policy on marines and islands must keep consistency. Thus, this study suggests the enact of a tentative “framework act on marine and island” which includes provisions on preservation, management, use, development, carrying out laws and safety concerning the marine area.
