초록
미국 헌법은 우리 헌법에 적지 않은 영향을 끼쳐왔다. 그 중에서도 특히 미국헌법상 표현의 자유 법리가 우리 헌법이나 헌법재판소의 헌법 해석에 끼친 영향은 독일 헌법 등 다른 나라 헌법의 영향보다 적지 않다고 믿는다. 표현의 자유는 민주사회를 떠받치는 중요한 기본권의 하나로서 ‘우월적 지위’를 가지는 것으로 평가된다. 이러한 표현의 자유에 대한 통제를 통제의 시점을 기준으로 ‘사전적 통제’와 ‘사후적 통제’로 크게 나누어 봤을 때, ‘사전억제 금지의 원칙’은 ‘사전적 통제’의 대표적인 예에 속한다. 미국 연방대법원은 미국 수정헌법 제1조가 규정하고 있는 표현의 자유에 대한 ‘사전적 통제’에 관한 원칙으로 일찍이 ‘사전억제금지원칙’(Prior Restraint Doctrine)을 탄생․발전시켜 왔고 적지 않은 법리들이 축적되어 있다. 따라서 미국의 ‘사전억제금지원칙’의 의미와 내용 및 그 바람직한 적용에 대해 연구하고 이것을 우리에게 맞는 표현 규제 입법의 합헌성 심사기준으로 소화해내는 것은 자못 뜻 깊은 일이라 할 수 있다. 이런 문제의식에 근거해서, 본 연구는 미국헌법상 표현의 자유 법리가 우리 헌법에 미친 영향을 ‘사전억제 금지의 원칙’을 중심으로 살펴보는 것을 연구의 목적으로 삼는다. 그리고 이를 위해 우선 미국헌법상 표현의 자유에 대한 ‘사전적 통제’법리로서 ‘사전억제 금지 원칙’의 탄생과 발전을 미국 연방대법원 판례의 법리를 중심으로 개관한다. 그리고 이에 기반해 미국의 ‘사전억제금지 원칙’이 국내에 어떻게 도입․적용되고 있는지, 우리 헌법이나 학계 및 법 실무계, 그 중에서도 특히 우리 헌법재판소의 판결에 어떤 영향을 미쳤는지를 분석하고, 적용상의 특징은 무엇인지를 귀납적으로 탐구한다.
Abstract
The U.S. Constitution has given great influence to the Korean one since the establishment of the First Korean Constitutional Law. Among the influences, that of the principle of freedom of expression in the U.S. Constitution cannot be underestimated. The freedom of expression is esteemed to have a superior status to the other constitutional rights in supporting a democratic society. The restriction of the freedom of expression is divided into two categories; the prior restriction and the ex post facto restriction. The Prior Restraint Doctrine is concerned with the former. The U.S. Supreme Court has developed the principle of the prior restraint doctrine since long ago. This paper aims at exploring the influence of the principle of the freedom of expression focusing on the prior restraint doctrine. For that, it overviews the contents of the prior restraint doctrine that has been developed by the U.S. Supreme Court focusing on the major cases. Then, it will analyze its influence to the decisions of Korean Constitutional Court as well as to the Korean Constitution and the constitutional jurisprudence in Korea.
