우리나라 지속가능성 관련 법제의 헌법적 검토

Since the Industrial Revolution, the policies to cope with many kinds of crises including serious environmental pollution during a growth process has become as an urgent issue of the international society as well as of every other nations. Thus, the debates on the ‘sustainability’ have extended to various fields such as economy, society and so on in order to overcome these kinds of crises. The Sustainability has been enlarged as a important issue for human race since Rio Conference of 1992. A regulatory power of international conventions declaring a Sustainability have been recognized widely after the Rio Conference. By extension, every nations in the world have adopted a sustainability into their own regulations and constitutions, which manifestly prove that a sustainability is being emerged as an crucial value to overpass those crises that human race is facing at the present moment. Accordingly, South Korea is endeavoring to participate in such international movements to actualize the sustainability, and finally has adopted the enactment of ‘Framework Act on Sustainable Development’ to her domestic law. Especially, the changes of today's societies tend to occur very rapidly and simultaneously throughout the various fields. However it is a logical presumption that damage was estimated to be in the billion of dollars not mentioning a following recovery period on a long-term basis. In this situations, controversy on ameliorating a legal system to implement the enactment of laws with respect to sustainability has been appeared as an urgent issue as much as the emerging importance of the sustainability. Therefore, this study is aimed at researching on the methods of legislating the laws and regulations related to a sustainability with a view to overcome such serious crises of every fields and to construct a system as well that can contribute to improving a life quality of people for the future of this country.
