과세행정에 있어서 금융정보의 활용 정도에 대한주요국의 입법례 고찰

금융정보분석원이 보유하고 있는 금융거래정보의 과세행정 활용에 관한 논의는 금융프라이버시권과 조세정의가 첨예하게 대립하는 대표적인 사례에 해당한다. 소득이있는 곳에 세금이 있다는 원칙을 실현하기 위해서는 현재 포착되지 못하는 세원을 추가로 확보할 필요가 있고 그 점에서 금융정보분석원이 확보하고 있는 금융거래정보가유용하게 사용될 여지는 상당하다. 그러나 금융정보분석원은 범죄관련성이 의심되는거래를 법집행기관에 통보하는 역할을 하는 기구로서 원칙적으로 국민의 사생활보호와자금세탁방지라는 공익실현 간의 조화의 취지 내에서 운영되어야 하는 까닭에 국세청과 같은 기관에 과세행정목적상의 거래정보의 제공이나 원시자료에 대한 접근, 제한없는 접근 등을 허용하는 것은 본 제도의 근간을 훼손하게 한다는 주장도 제기된다. 본고는 미국, 영국, 일본 등 주요국의 관련 법제도를 고찰하고 기본적인 운영실태를 파악함으로써 이러한 견해의 다툼에 참고할 수 있는 단초를 제공하고자 하였다. 과세행정목적상 FIU의 금융거래정보의 국세청과의 공유 내지 활용은 일본 등 일부 국가를 제외하고는 대부분의 OECD 국가들에서 허용하고 있다. 다만, 구체적인 활용방법과 자료의 접근방법 등에 있어서는 국가별로 차이가 있음을 확인하였다. 고액현금거래보고제도와 의심거래보고제도는 국가별로 도입여부와 국세청의 FIU 정보에 대한 접근정도가 상이함을 보았다.
Abstract
A controversy about application of financial information retained by Financial Intelligence Unit(FIU) in tax administration is a classic example of a conflict between financial privacy and tax justice. To impose a tax on income requires to secure the source of taxation. Thus, an assertion that is to use the financial information seems to be persuasive. The purpose of FIU is to notify transactions which could be related to crimes to the related institutions. Therefore, to provide raw data to IRS or allow IRS to access to raw data could ruin purpose of establishing FIU. This study tries to investigate legislation case of application of financial information in tax administration and offer of beginning to resolve a conflict of opinions as stated above. Except some nations such as Japan, most of OECD countries allow IRS to access to financial information hold by FIU or sharing financial information. There are differences between countries in specific utilization methods and access method to financial information. Also, there are differences in adoption of CTR and SAR.
