초록
소음에 대한 인식이 상당한 수준으로 변화하고 있는 현 상황에서, 집회 및 시위에서 발생하는 과도한 소음에 대한 규제의 대책을 요구하는 목소리가 높아지고 있다. 그러나 집회 및 시위의 자유는 민주주의의 발전을 위하여 근본이 되는 기본권이라는 점에서 여전히 헌법적 즁요성을 보유하고 있다. 기본권 보호의 측면에서 학계에서는 여전히 우월적 지위를 유지하는 관점이 우세하고 있으며, 우리의 법체계가 그러한 이상을 따라가지 못하고 있는 현실에 대하여 강한 비판이 존재하는 것 또한 여전하다. 반면에 그 실행의 방법에 대하여서는 사회 변동에 유연한 적용이 있어야 한다는 주장이 있다. 특히 집회 및 시위의 과정에서 발생하는 확성기 소음을 특별한 규제의 대상으로 놓을 필요가 발생하고 있다. 상대방에게 고통을 부여함으로써 설득의 유인을 찾는 방식으로는 더 이상 타인으로부터 지지를 받기 어려워지는 현실을 감안할 때, 현행 규제 시스템보다는 좀 더 적극적인 형태의 규제가 필요하다고 본다. 본 연구에서는 집회 및 시위에 있어서의 소음에 특별한 관심을 두고 규제하고 있는 미국의 법제와 연방대법원 판례를 통하여 우리의 현실에 맞는 규제의 모습에 관한 시사점을 찾고자 하였다. 구체적으로, 소음 규정의 적용에 비례의 원칙을 적용할 것과, 확성기 사용 신고제를 별도로 운용할 것을 제안하였다.
Abstract
Voices on stronger regulations on the excessive noise producted by the assembly and association gain powers based on the changed conception on noise. However, freedom of assembly and association should not be suppressed because it is a foundational right for the success of democracy. Academia, which aims for more protection of individual rights, takes the preferred position for freedom of assembly and association, and continues to criticize the stagnated present situation. By contrast, people claim that realization of the freedom should be flexible to the changing society. Particularly, necessities for stricter regulations on the sound amplifier during the assembly and association are growing up. The writer suggests that we should choose the stricter regulations than the current one because the assembly and association has to gain voluntary popular supports for its justification. In this article, this project tries to find suggestions for our reasonable regulation framework from the U.S. regulations and the Supreme Court decisions.
