쌍방과실로 인한 충돌 사안의 취급에 관한 판례연구

본 연구에서는 쌍방과실에 따른 충돌사안에 대한 소송비용의 지급에 관해 분석하는 것에 목적을 두고 있다. 이 사안에서 Western Neptune호는 지진탐사선이며, St. Louis Express는 컨테이너선으로 멕시코만에서 발생한 두 선박의 충돌사안과 관련된 것이다. 원고가 입은 손해는 매우 거대한 것으로 대개 2,500만 파운드로 추정된다. 더욱이 이 사건은 새로운 논점을 제기하는 것이다. 이 사건에서 두 선박은 AIS를 구비하고 있었던 외에 St. Louis Express호는 VDR이 장비되어 있으며 레이더화면의 복사와 VHF 교신, 선교에서의 대화도 녹음되어 있다는 사실에도 불구하고 쟁점으로 부각되었다. 그러나 이 사건에서의 주요한 쟁점은 피고에 의해 주장된 바와 같이 Western Neptune호도 충돌에 대한 과실이 있었는지의 여부의 문제이었다. 법원은 Western Neptune호의 과실은 위반정도와 사고발생에 대한 기여도가 매우 적기 때문에 과실비율은 St. Louis Express호에 2/3, Western Neptune호에 1/3로 판결하였다.
Abstract
The purpose of this study aims to analyse the payment of proceedings cost in collision case by the both blame. In this case, Western Neptune is a seismic survey vessel, and St. Louis Express is a motor container vessel. This action arise out of a collision with Western Neptune and St. Louis Express which occurred in the Gulf Mexico. The losses sustained by the claimants are very substantial, said to be in the region of ₤25 million. Further it raises some interesting and novel issues. These issues have emerged despite the fact that there is a photographic record of the radar picture(including AIS data) on one of the vessels and there is an audio recording on the bridge of that vessel which includes all the VHF exchanges with the other vessels in the vicinity. It was accepted by defendants that St. Louis Express should bear the preponderance of blame for the collision. But the principal issue in the case was the question whether, as contended by the defendants, Western Neptune was also to blame for the collision. The court was held that the fault of Western Neptune were substantially less blameworthy or indeed causatively potent than those of St. Louis Express. The court would apportion liability one third/two thirds in favour of Western Neptune.
