노인복지행정에 있어 “지역포괄케어시스템”의 구축에 관한 검토- 2011년 6월 일본의 개호보험법 개정 내용을 중심으로 -

21세기에 들어서면서 우리나라는 이전에는 경험하지 못한 급속한 고령화가 진행 되고 있는데, 이에 대한 대처로서 고령자의 생활의 질을 유지 또는 향상시키고 증대하는 고령자 의료 및 개호비용에 대응하기 위한 “지속가능한 보험제도”의 구축이 시급히 요구되어지게 되었다. 이에 우리나라에서 2008년 7월부터 본격적으로 “노인장기요양보험제도”를 시행하고 있다. 한편 최근 일본에서 2011년 6월 15일 “개호서비스의 기반강화를 위한 개호보험법 등의 일부를 개정하는 법률”이 성립되면서, 기존의 “사회에 의한 개호”에서 “지역에 의한 개호”의 전환을 시도하고 있는데, 그 내용으로 의료와 다른 서비스와의 연대강화, 개호인력확보와 서비스 질 향상, 보험료 상승의 완화추진, 인지증 대책의 강력 추진 등을 핵심 골자로 한 “지역포괄케어시스템의 구축”을 도모하고 있다. 이번 개정의 의미는 요개호자상태라도 가능한 한 지역에서 생활을 보내는 것이 가능한 환경을 구축하려는 “노멀라이제이션 이념”의 실현에 가장 큰 역점을 둔 개정이라고 평가할 수 있을 것이다. 즉 일본의 “지역포괄케어시스템”구축의 취지는 “노인들이 먼 시설에 보내지지 않고 자신이 사는 동네에서 365일 서비스를 받게 하자는 것”으로, 우리나라에서 최근 점차 늘고 있는 무연 간병 등을 해결하는데 하나의 실마리가 될 것으로 보인다. 끝으로 일본의 이러한 제도의 도입을 검토함에 있어 제도의 효율향상과 비용저하의 측면에서 우리 실정에 맞는 광역지방자치단체와 기초지방자치단체간의 복지행정에 대한 역할분담문제, 요개호자의 자기결정권과 관련한 보호 문제, 전문가 집단의 구축 문제 등 지역포괄케어시스템의 구축을 충실히 기하기 위한 관계 법령 전반에 대한 종합적인 재검토가 이루어지기를 기대한다.
Abstract
South Korea is facing a rapid aging had never experienced even once from the 21st century. Re-establishment of a sustainable insurance system that could support long-term care expenses and medical expenses of elderly is required urgently. And therefore Korea is enforced and make insurance system for long-term care for the elderly in earnest from July 2008. On the other hand, Japan has developed the Long-Term Care Insurance Act quickly than South Korea and has decided to amend the part of the Long-Term Care Insurance Act on June 15, 2011 to strengthen the foundation for long-term care services. Amendment of this Long-Term Care Insurance Act brought a paradigm shift, that is “Care by Region” from the previous “Care by the Society”. It is the welfare and improvement of the quality of the medical unification and service and correspondence of dementia or the restraint of the expense as main content in the revision of this Long-Term Care Insurance Act. And the main significance in the revision of this Long-Term Care Insurance Act is that the elderly person who must receive a care service would receive the care service that is enhancement at home with one's area for 365 days and 24 hours. It must be considered for the roles of the national and local governments for costs before introducing it from this system. In addition, it must be considered with the development of legislation related to the protection of the right to self-determination of older people requiring care and training of care professionals and construction of care a comprehensive system of local as well.
