미술품 유통에 대한 행정적 규제

초록
한국의 미술품 시장은 장기적인 경제적 불황으로 인하여 미술품 거래가 현격하게 감소하는 현상과, 작품의 가격이지속적으로 하락하는 위기 속에 내부적으로 기본 유통질서를 저해하는 여러 가지 거래 형태가 행해짐에 따라 건전하고 투명한 흐름을 방해하며 혼란을 가중시키고 있는 상황이다. 이러한 미술품 시장의 문제점은 유통구조의 후진성, 중간 유통상의 난립과 감정시스템의 미흡, 규모의 경제에 미흡으로 나타나고 있다. 그렇기 때문에 미술품 유통질서의 확립을 위하여 그에 대한 적절한 행정적 규제가 뒤따라야 한다. 이러한 상황에서 공인중개사, 공인연예인관리자, 그리고 학예사 등에 관한 법제를 참고하여, 국가가 미술시장을 방임할 것이 아니라, 미술시장의 유통거래의 안전과 투명성, 그리고 일관된 질서를 위해서는 미술품 유통하는 자(art dealer)의 자격과 요건을 법률에 근거한 제도로 발전시킬 필요가 있다. 다만, 지나친 규제 입법 때문에 미술품 유통의 자유가 침해되지 않도록 유의해야 하며, 이를 위하여 미술품 유통의 투명성, 안정성을 확보하기 위한 최소한의 가이드라인을 정하고 그 외의 부분에 대한 입법을 자제해야 할 것이다. 구체적인 방안으로는, 가칭 미술품유통관리법을 제정하여 미술품 유통업 등록제의 시행, 미술품 거래이력 신고제의 시행, 효율적이고 공신력 있는 감정시스템의 구축, 도록(카탈로그 레조네)의 발간, 불법적 거래행위에 관한 책임 등에 대한 행정적 규제를 취해야 할 것이다.
Abstract
Since there is no on-going regulation of the transaction of artwork, art dealing and pricing of artwork are not credited in Korean art market, which has been the main reason why Korean art market still remains at the under-developed stage. The administrative regulation of the transaction of artwork and its drawbacks, therefore, should be studied in terms of economic and administrative law perspective. For the rationale for its regulation of art market and art dealers, there shall be thoughtful consideration in its method or degree of regulation to be appropriate. Regarding the administrative regulation under upcoming relevant law, the regulation for certain types of dealing and dealers are needed to be defined precisely, which could guarantee the free market for the players in art market. It is necessary to analysis what is proper and reasonable in the regulation of transaction pursuant to the foreign countries, such as US, China, France and England. Also, administrative regulation of the transaction in other areas, including real estate and entertainment business, might provide the guideline to art market.
