Undergraduate Legal Education in the Era of the Law School: Goals, Methods and Strategies

이 연구는 로스쿨 도입 이후 학부의 법학과나 법학전공이 어떤 변화를 겪어 왔는지를 점검하고 그 원인을 진단해 본 후, 변화된 상황에 걸맞은 학부 법학교육의 목표를 정립하고 이를 실현하기 위한 교육과정과 교육방법을 모색하는 것을 목적으로 한다. 이를 위하여 우선 학부 법학교육을 위한 조직과 정원, 교육과정의 변화를 실제 자료조사를 토대로 분석하였다. 그 결과 법과대학이나 법학부의 조직상 변화는 뚜렷이 나타나진 않았으나 일정한 수준의 정원 감축이 있었음을 발견할 수 있었다. 또한 교육과정에서도 일정한 변화가 수반되었다. 이러한 현실 진단을 바탕으로 로스쿨 도입 이후 학부 법학교육의 목표를 정립하기 위한 시도를 하였다. 우선 이러한 시도를 해 온 선행연구에 대한 분석과 평가를 통하여 선행연구들의 성과는 무엇이고 한계는 무엇인지를 평가한 후, 그러한 한계를 극복하기 위한 대안적 목표를 제시하였다. 그 결과 필자는 학부 법학교육은 기본법률과목에 대한 최소한 이상의 이론교육, 비법학부 학생들을 고려한 개방적 교육과정, 그리고 다양한 교과외 활동을 통한 학생 수요의 충족 등을 목표로 삼아야 한다고 제안하였다. 마지막으로 새로이 정립된 학부 법학교육의 목표를 실현하기 위하여 가장 적합한 교육내용과 교육방법을 모색해 보았다. 이를 위해 이론교육, 교양교육, 진로교육이라는 세 가지 관점에서 필요하고도 적절한 교육과정과 교육방법론을 제시하였다.
Abstract
This article aims at establishing the objectives of the undergraduate legal education and searching for appropriate curricula and educational methods to serve those goals. To do this, I analyzed the changes in the organizational structure, size and curricula that legal departments at various colleges and universities had experienced since the introduction of the law school system. In the course of examination, I found some meaningful changes like reduced scale of the departments and their curricula, which, in my view, would greatly influence the maintenance and performance of undergraduate legal education. Based on the diagnosis of such changes, I tried to grope for an appropriate goal of undergraduate legal education under the newly introduced law school system. After analyzing and evaluating several previous researches thereon, I suggested some alternative goals: to provide an education of legal theories to furnish students with basic problem-solving capacities, to offer elementary legal knowledge for students who major in other subjects, and to satisfy diverse practical needs of the students through various extracurricular activities. In the end of this article, I proposed some principles regarding the organization of curriculum and educational methodology suitable to achieve those goals.
