On Perfecting Qualification Penalty of the Corporate Crimes in China's Penal Code

Although the company has been recognized as the subject of criminal responsibility and the bipartite punishment system against corporate crimes has been established in ’s new penal code, the arestillfarfromperfect. Thisarticle,withtheanalysisofthecontentsandthemodeofthecorporatecrimes’ regulations in China’s new penal code, points out the defects and deficiencies in the regulations of qualification penalty; and by demonstrating the reasonableness of setting new qualification penalties against the corporate crimes, suggests that we should learn the legislative experiences of civil law countries and further improve the regulations of corporates’ criminal responsibility.
