우리나라에서 퍼블리시티권(the right of publicity)보호에 관한 소견

초록
최근 우리나라에서 퍼블리시티권에 대한 관심이 높아지고 있다. 이는 한류열풍으로아시아 여러 나라에서 연예 및 스포츠산업의 스타들이 많은 인기를 얻고 있고, 이들스타들을 활용한 마케팅에서 발생할 수 있는 초상권과 성명권 등의 재산적 권리에 대한 인식을 재고하고 보호 방안을 마련하여야 한다는 의견이 표출되는 것과 관련 있다. 실제 이와 관련한 분쟁도 증가하고 있는데, 그 중심에 있는 것이 소위 퍼블리시티권이다. 그런데 현재 퍼블리시티권에 관한 논의는 백가쟁명식으로 이루어지고 있다고 필자는 생각한다. 퍼블리시티권을 부정하는 견해부터, 이에 관해서 별도의 입법이 필요하다는 설, 퍼블리시티권을 정면으로 인정하는 견해, 퍼블리시티권에 대한 실체가 불분명하더라도 퍼블리시티권이라는 용어를 사용하자는 견해, 재산권으로 보자는 견해,재산권으로 보더라도 지적재산권의 하나로 보자는 견해, 인격권의 재산권적인 측면을 인정하자는 견해 등 다양한 형태로 논의가 진행되고 있다. 필자는 퍼블리시티권의 실체는 이미 우리 판례를 통하여 인식되어왔고, 명칭부여의문제에 지나지 않는다는 점을 본고에서 밝힌다. 또한, 그 동안 미국 등지에서 통용되어지는 퍼블리시티권이란 개념은 우리나라에서는 인격권의 재산적인 측면으로 인식되어 왔다고 보인다. 그리고 하급법원에서는 여전히 견해가 나누어져 있고, 학설도 충분히 뒷받침되지 않는 상태에서 특정국가의 이론만을 차용하여 입법을 시도하는 것도 생각해볼 필요가 있다고 판단된다.
Abstract
This paper is written to review the legal protection of the right of publicity in Korea. The concept of the right of publicity has been developed from the U.S.A. in the form of case law. In recent days, the right of publicity is strongly discussed in Korean Legal Society because Korean Entertainers have been famous for their songs and performances in the world. And the cases to be filed to the Korean District Courts on the ground of the infringements of their names and portraits without their consent on the entertainer’s name and portrait have been increased in recent years. Moreover, the view-points of the right of publicity among the Korean Scholars and Judgements of District Courts are divided into various ways from negative points not to acknowledge it as a kind of right to the positive points to affirm it as a right in the Korean Legal System. Up to now, even a case in related with the right of publicity has not been filed to the Korean Supreme Court. But in my opinion, the right of publicity has been protected as a right of person for a long stretch of time in Korea.
