영화 산업의 관점에서 바라본 저작권법해석에 관한 연구

한국 영화는 지난 10여 년 동안 성장과 위기를 반복하며 영화산업의 위상을 국내는 물론 해외로까지 확산시켜 왔다. 또한 영화진흥위원회(이하 영진위)는 ..2012년 한국 영화산업 결산보고서..와 ..2013년 상반기 결산보고서..를 통해 2년 연속 관객 1억 명 돌파를 예측하며 한국영화산업이 지속적으로 성장할 것으로 전망하고 있다. 이러한 영화산업의 성장과 함께 최근 영화의 저작권 귀속과 분배, 영화에서 사용된 음악저작물의 공연료 징수와 관련한 법적 분쟁 등 새로운 문제들이 대두되기 시작하였다. 또한 영진위 주관 하에 개발되고 있는 ‘표준계약서’는 물론 영화산업의 ‘임금단체협상’, 투자/배급사와 제작사 간의 저작재산권 귀속에 대한 이견 등으로 확산되고 있다. 이로 인해 한-EU, 한-미 FTA 등으로 한국영화가 해외 수출 경쟁력에 영향을 끼칠 수도 있다. 본 연구의 목적은 그동안 영화와 관련해 저작권법에서 규정하고 있는 조항들을 영화산업의 관점에서 새롭게 바라봄으로써 영상저작물의 저작자 보호, 영상제작자의 추가적 권리, 그리고 영화산업의 권리귀속 등을 분석하고, 나아가 한국 영화산업에서 필요로 하는 저작권자의 엄격한 기준과 운영, 효율적인 관리, 그리고 저작권 체계에 대한교육 강화 등을 제시하는데 있다. 이를 통하여 영화산업의 다양한 이해 당사자들이 상호 신뢰를 바탕으로 새롭고 합리적인 방식의 관계 맺기를 통해 영화산업의 동반자로서 함께 방향을 제시하고 고민해 나갈수 있을 것이다.
Abstract
As Korea films have repeated growth and crisis over the last 10 years, they have extended the position of the film industry to other countries as well as Korea. Also Korea Film Council (hereafter KOFIC) forecasts that it will exceed 100 million audiences in the second year in a row and Korea film industry continues to grow through “2012 year-end report on Korea film industry” and “2013 first half report”. With the growth of the film industry, new issues such as possession and distribution of copyright of films, and legal disputes related to charging fares for public performance of musical works used in the films have emerged. In addition, it has been expanded into ‘standard contract’ being developed by KOFIC, ‘collective wage bargaining’ and different opinions about possession of copyright between investment/distributing agencies and production companies. Thus, Korean films can bring an effect to their competitiveness in export due to FTA of Korea-EU and Korea-USA. The purpose of this study is to analyze the protection of authors of Cinematographic Works, additional rights of a producer of cinematographic Works and possession of copyright of the film industry, and present strict standards and operation of authors, efficient management and enhancement on education for the copyright system by looking at provisions specified in the copyright law related to films in a new light from the perspective of the film industry. On the basis of mutual trust between various stakeholders in the film industry, they can make new and reasonable relationships and go together towards the direction of growth of the film industry as companions.
