Spread of smart applications with IT development makes us createvarious digital contents and share them through internet. We may callthese contents as data. Today, Big Data has become a hot keyword allover the world in that Big data may be defined as collection of data setsso large and complex that it becomes difficult to process using on-handdatabase management tools or traditional data processing applications. Big Data is useful basic resources for analysing phenomenon to draw acertain output. However, There are some legal issues we need todiscuss, especially in copyright sector. In a course of data miningthrough hadoop which is functioning distribute data processing,temporary reproduction is inevitably accompanied. And the issue is thesubject of temporary reproduction here is works(including database)protected by copyright act. And the issue here is the subjects oftemporary reproduction may include copyrighted works includingdatabase. This paper review the legal issues focusing on the temporaryreproduction occurred in a process of datamining under KoreaCopyright Act subparagraph 22 of Article 2 and paragraph 2 of Article35. And it also examines other temporary reproduction issues related toBig Data such as fair use doctrine.
