중소기업 법률지원정책의 문제점과 개선방안-법무부 중소기업법률지원단의 법률지원제도를 중심으로

최근 기업환경의 급격한 변화로 말미암은 중소기업문제의 본질은 결국 경쟁력문제이다. 이와 관련하여 알아야 할 점은 중소기업의 경쟁력은 경쟁적 구조에서 나온다는 점이다. 경쟁적 구조를 저해하는 가장 큰 요인 중 하나는 정부의 중소기업정책과 법제도일 수 있다는 점이다. 현행 법률지원정책은 다수의 기존 중소기업에 대한 직접적 단기적 소송비용지원이라는 기존의 기업에 대한 관행적이고 통상적인 지원을 그 내용으로 하고 있다. 글로벌시대의 바람직한 중소기업에 대한 법률지원정책의 방향은 기존의 중소기업에 대한 직접적 지원이나 보조 보다는 경제전체의 효율성을 높일 수 있도록 중소기업의 경쟁력을 강화하는 방향으로 전환되어야 한다. 중소기업법률지원정책의 방향은 기존의 중소기업에 대한 단기적이고 직접적인 법률지원이 아니라, 중장기적으로 중소기업의 경쟁력을 제고하는 구조적 지원정책이 되어야 한다. 중소기업 법률지원제도의 효율적 구축을 위해서는 법무부, 중소기업청 등 중앙정부기관과 지방중소기업청 등 지방정부기관이 참여하는 다층적 지배구조를 고려해 볼 필요가 있다. 또한 수요자인 중소기업자가 접근하기 쉽고 활용하기 쉬워야 하며, 이를 위해 법률지원제도의 체계가 단순하고 정연하며 내용이 명료하고 평이하여야 한다. 이러한 수요자인 중소기업 중심의 효율적인 중소기업 법률지원정책을 위해서는 중소기업기본법의 체계적 정비와 더불어 중소기업법률지원에 대한 중소기업기본법상 법적 근거를 마련할 필요가 있다.
Abstract
This paper is concerned with problems and legal solutions of the legal service system for Small and Medium Enterprises(SME) in Korea. The business environment related to the Small and Medium Enterprises(SME) has recently changed by global competition. With the change of the business environment, it is necessary to establish new SME policies in Korea. Small and Medium Enterprises(SME) serve as a source of dynamism of the korean economy and play a leading role in providing goods and services, creating employment opportunities, acting as a seedbed for market competition, and contributing to the development of regional economies and societies. To enable this source of dynamism for the korean economy, the SME policies will encourage SMEs to be innovative in business and respond to change in the business environment, and develop the environment to lay the foundations for the growth in the global economy. In order to achieve this, the SME policies of korean government should be based on the competition policies in th small business sector. The legal service system for Small and Medium Enterprises(SME) of government in Korea is intended for all Small and Medium Enterprises(SME) to support directly certain amount for their legal costs. Some survey research shows that the current korean legal service system for the SMEs has several problems. In order to improve problems, the legal service system for Small and Medium Enterprises(SME) as a SME policy and legal service system for the SMEs should be based on the competition policies. They will encourage SMEs to increase their competitiveness for the growth in the global economy. The Basic Act on SMEs of Korea should be also amended towards support for the new SME policies based on competition policies and structural changes for SMEs, like the amendment of Small and Medium Enterprise Basic Act of 1999 in Japan.
