헌법 제119조 제2항 ‘경제민주화’의 의미

이 논문에서는 헌법 제119조 제2항에 규정된 “경제주체간의 조화를 통한 경제의 민주화”의 의미를 밝혀보고자 하였다. 이른바 ‘경제민주화’는 헌법적 규범이며, 그 의미는 경제와 민주주의의 관련성 속에서 올바르게 이해될 수 있다. 그리고 그 관련성은 헌법상 민주주의의 이념으로 이해되는 자유와 평등이 경제헌법이 시장경제에서 실현하려 하는 자유와 평등과 다르지 않다는 점에서 찾을 수 있다. 따라서 여기서 “민주화”란 경제관계에서 민주주의 이념의 실현, 즉 경제관계에서 자유와 평등이 실질적으로 실현되도록 하여야 함을 의미한다. 경제에는 경제주체들 간의 잠재적 갈등이 언제나 존재한다. 이러한 갈등은 다양한 가치들의 상호 충돌로 나타날 수 있다. 헌법 전문에서 규정하는 ‘자율’과 ‘조화’는 시장경제질서를 포함하는 자유민주적 기본질서를 이해하는 단초가 되며, 특히 제119조 제2항의 경제민주화는 ‘조화’의 문제를 다시 구체화한 것으로 해석된다. 현실적으로 경제상의 자유와 평등이란 경제법질서, 즉 헌법상 국가의 경제규제와 조정을 통해 경제주체들 간에 자유와 평등이 보장됨으로써 실현될 수 있다. 따라서 경제를 둘러싼 가치들의 잠재적 충돌을 해소하고 조화시킬 수 있는 다양한 방법, 특히 사회·경제입법이 필요하며, 그러한 요청은 헌법상 경제민주화에 근거한다. 결국 ‘경제민주화’란 다양한 경제관계에 있어서 경제주체 간의 조화, 즉 갈등하고 충돌하는 가치들 상호 간 조화의 실현을 의미하며, 그 원칙적 방법 역시 민주주의에 있음을 의미한다. 경제민주화는 어떤 특정한 과제들을 중심으로 좁게 이해되기보다는 넓게 이해되며, 조화로운 실현이 요구되는 다양한 경제적 과제들이 이에 근거하거나 이로부터 도출될 수 있게 된다. 경제를 둘러싼 가치들 간 조화의 실현을 뜻하는 경제민주화는, 사실로서의 경제현실에 대해 어떤 규범적 요청이 가해지는 가교(架橋)의 기능, 즉 헌법적 연결고리가 되며, 국가는 헌법상 경제민주화에 근거하여 다양한 경제 관련 규제와 조정의 역할을 수행하고 때로는 관련 기본권을 제한하게 된다. 소위 경제민주화 입법이란 경제주체간의 조화와 공존의 질서를 구축하기 위하여 행해지는 국가의 경제규제와 조정의 하나로 이해된다.
Abstract
This paper presents the meaning of the “democratization of national economy through harmony among the economic agents” according to the paragraph 2 of article 119 of economic constitution of Korea. The relationship between economy and democracy is based on a fact that the freedom and the fairness in the economy belong to those rights assured by the spirit of democracy in the constitution. In a practice, the freedom and the fairness in the economy embody the guarantee of those rights among economic agents by economic law, that is regulations and adjustment of national state in the constitution. As Karl Polanyi said, a free market is the fruit from a institutionalized economy by state. We can also say that there are always potential conflicts among economic agents in the economy. When it comes to the role of law and order based on the economic democracy, it is to provide the solutions to the potential conflicts among values which are held by each economic agent in the market competition. Hence, we need different ways, especially social, economic law-making to make potential conflicts among values surrounding economy to be in balance or harmony, and the requests for which are derived from the economic democracy in the constitution. Therefore, the meaning of the democratization of economy can be explained by the harmony of conflicts among values or the settlements of potential disputes among economic agents in the economy, expecially by economic regulations and adjustment based on the constitution. This is how I compromise so-called 'economic democracy' in this paper.
