국내 인터넷사이트의 개인정보 수집현황 분석

이 논문은 국내의 주요 인터넷 웹사이트와 애플리케이션 프로그램(앱)을 통해 수집되는 개인정보의 현황에 관해 파악하고 분석하는 논문이다. 조사결과 쿠키를 통한 정보의 수집은 주요 웹사이트에서 상당히 광범위하게 이루어지고 있는 것으로 파악되었다. 주요 웹사이트에 발견된 평균 당사자 쿠키는 12.48개이고 평균 제3자 쿠키는 8.44개이다. 이는 미국에서 2009년에 조사된 현황과 비교하면 매우 높은 수치인 한편, 미국에서 2011년에 조사된 현황과 비교하면 상대적으로 낮은 수치이다. 미국의 2011년 자료와 비교하면, 국내 웹사이트 현황의 가장 큰 특징은 당사자 쿠키의 개수는 그리 큰 차이가 없는 반면에 제3자 쿠키는 미국에 비해 20%에도 못 미치는 수준으로 훨씬 적게 발견된다는 것이다. 다른 한편, 쿠키 파일의 활용현황은 PC 환경과 모바일 환경에서 상당히 다른 양상을 보인다. 가장 큰 차이는, PC 환경에 비해 모바일 환경에서는 쿠키의 활용도가 현저히 낮다는 것이다. 이와 같은 쿠키 활용의 현황은 광고시장의 성숙도와 특징을 반영하는 것으로 추정된다. 모바일 기기의 경우에는 쿠키 이외에 앱을 통해서도 다양한 유형의 개인정보가 수집되고 있었다. 조사대상 주요 앱의 대부분이 IMEI에 대한 접근권한을 보유하고 있었고, 그 중 상당수의 앱이 접근권한에 기초하여 실제로 IMEI에 접근하여 정보를 수집하고 있다. 또한 USIM ID나 전화번호 등 다양한 유형의 이용자 정보를 수집하는 앱도 적지 않았다. 그런데 이용자들이 이처럼 수집되는 개인정보의 내용이나 경로 등에 관해 충분히 이해하고 있는지 또 그러한 이해에 기초하여 동의가 이루어지고 있는지는 불투명하다. 현황에 대한 파악과 분석, 그리고 그에 기초하여 정책을 수립하고 법제도를 완비하는 것은 규제의 현실성과 적실성을 높이기 위해 매우 중요한 것이 될 것이다.
Abstract
We investigated major Korean internet sites regarding their efforts to gather personal information on users. On average, 12.48 first-party cookies and 8.44 third-party cookies were found on these websites. These numbers are relatively high compared to the numbers reported in a 2009 study on the US, and relatively low compared to a 2011 report from the US. When compared to the 2011 report, it is noteworthy that the numbers of first-party cookies are similar in Korea and in the US but that the number of third-party cookies is much smaller in Korea. Also, the numbers of cookie files are notably different between PCs and mobile devices. In general, much smaller number of cookies were found with mobile devices. About mobile devices, ‘apps’ were also used as a major conduit for gathering user information. Most of the apps that we investigated retained their access rights on users’ IMEI and, indeed, many of these apps in fact did get access to users’ IMEI information. In addition, many apps were gathering USIM ID and phone numbers.
