The Issues of SW License Agreement and Copyright Infringement on Multi-user PC

SW utilization has become more active at the era of multi PC use than single PC. For the enhancement of SW copyright protection, SW Copyright holders have strengthened their License term which control user license usage such as Shrink-wrap or Click-wrap contract. The license terms include the number of SW usage range depend on the number of user or device, a user apply for new technologies to try to avoid the risk of copyright infringement and reduce a cost of SW purchase. In this process, PCs that can be used based on Server and multiple users was born. In recent years, a multi-user system technology that can independently make singe PC run on multiple users has appeared. It means that one SW installed in singe PC can be used by for many users. But Copyright holders insist that this is a copyright infringement using multi-user system without the permission of copyright holder. On the other hand, users insist that this is not a copyright infringement but a breach of contract. Remedies against infringement of license term could be different depending on whether copyright infringement or a breach of contract. This study suggests an alternative judgment on copyright act 46 which applies the rule through looking at whether SW infringement or a breach of contract on multi-user PC case.
