초록
제1기 헌법재판소는 우리 헌법재판의 초석을 놓은 재판부로 높이 평가된다. 본 연구는 이러한 제1기 헌법재판관들 중 김진우 재판관의 판결성향을 주요 사건을 통한 정성분석과 통계에 기반한 정량분석을 통해 규명함을 연구의 목적으로 삼는다. 그리고 이를 위해 우선 김진우 재판관의 주요 경력 및 행적을 살펴보고, 이러한 경력 및 행적에서 형성된 그의 세계관이나 인간관이 구체적인 결정에 어떻게 반영되고 있는가를 정성분석과 정량분석을 통해 탐구한다. 이러한 연구방법은 미국 법원학의 행태주의적 연구방법 중 ‘태도모델’을 주된 방법론으로 차용한 것이다. 판결성향 분석의 틀과 관련해 정성분석에서는 사법적극주의 및 사법소극주의, 사법진보주의 및 사법보수주의, 특히 사회적·경제적 소수자 및 약자의 권리를 신장시키려는 입장을 취했는지 여부, 청구인의 기본권 ‘보장을 확대’하려고 했는지 아니면 청구인의 기본권 ‘제한을옹호’하려 했는지 여부의 네 가지 분석틀을 사용하고, 정량분석에서는 사법적극주의 및 사법소극주의의 분석틀을 사용한다.
Abstract
The First Constitutional Court in Korea is esteemed that it placed the Courton a secure footing. This paper aims at exploring the judicial inclination ofJustice Jin-Woo Kim in the First Korean Constitutional Court. To achieve theaim, this paper will examine the life path of Justice Kim from his birth andto his appointment as a Justice. Then, it will qualitatively analyze hisopinions through the six major cases representing political, economic, socialand cultural fields. In addition, this paper will quantitatively analyze hiswhole opinions based on the statistics as well. For the qualitative analysis,the four analytical frames such as ‘judicial activism v. judicial passivism’ and‘judicial progressivism v. judicial conservatism’ will be used while, for thequantitative analysis, only the frame of ‘judicial activism v. judicial passivism’will be used.
