초록
현재의 경제위기를 극복하기 위해서는 경제를 이해하는 방식의 근본적인 변화가 필요하며, 정치와 경제, 정부와 시장의 관계를 새롭게 정의해 자본주의 시스템의 구조적 전환을 이루어야 한다. 이를 위해서는 우선 이전의 경제인식이 정부와 시장의 역할 가운데 하나만 강조함으로써 서로 대립적인 것으로 인식했던 것과는 달리 정부와 시장이 모두 불완전하다는 사실에 기초하여 정부와 시장을 서로 협력하는 관계로 설정해야 한다. 이 경우 정부의 시장에의 관여를 과도하게 부정하거나 반대로 정부의 시장개입이 지나치게 이루어지는 경우를 배제하기 위해서 상호 관여할 수 있는 한계의 설정을 위한 기준이 필요하다. 자본주의 시장경제질서를 전제로 하는 한 이러한 협력관계를 구축하기 위해서는 정부의 시장에의 관여는 원칙적으로 시장실패의 경우에 한정하여 이루어져야 할 것이다. 그러나 법 영역에서는 경제문제를 단순히 경제논리만 갖고 판단할 수 없다. 법의 가장 핵심적인 역할은 법적 주체들 간의 이익충돌을 합리적으로 해결하는 것이므로, 법 영역에서 경제문제를 판단하는 데에는 경제논리 외에 다른 사회, 정치적 보호법익들이 종합적 고려되어야 한다. 이러한 사회적, 정치적 목적의 고려에는 자본주의 성립 이후 법은 자유의 보장과 불평등의 개선으로 자유와 평등을 포괄한 민주주의의 원리들이 확산되고 심화되는 방향으로 변화해 왔다는 점이 고려되어야 한다. 이러한 기준은 정부의 시장에의 관여를 가능하게 하는 근거가 되는 동시에 한계로서의 역할을 하게 될 것이다. 따라서 시장실패 외에도 이러한 사회, 정치적 목적에 의한 정부의 시장에의 관여는 가능할 것이다. 그러나 정부의 시장에의 관여는 시장경제질서를 파괴하지 않는 선에서 이루어져야 할 것이다.
Abstract
Current global economic challenges caused by the 2008 global financial crises have been continuing until now. These financial crisis has essentially been considered as the problem of neo-liberal economic system, the theoretical foundation of the recent global economy. Above all, a series of global economic crisis is not temporary economic phenomenon from economic cycle but a long-run structural problem of the world economy. The most important cause of the global financial crisis is the absence of a proper government control over the market. In order to solve these economic crises, all the countries of the world have been establishing proper market control systems. However, related discussions in Korea have mainly been superficial approach and furthermore remained the passive stance compared to foreign countries. It is necessary to grasp the flow of change in the modern law to solve the structural problem of the economic crisis in the area of law. As a result, we can estimate the direction of change in the future law and take it as important guidelines in the legislation process and the application of the law. In addition, it is needed to critically investigate the legal system during Neo-liberal period and to consider the law system for the proper control of the market.
