교육 복지의 구현을 위한 정책적 함의 ― 노르웨이의 교육 복지 관련 법제도적 특징을 참고하여 ―

교육의 중요성에 따라 각 국가들은 자신의 정치․사회․문화적 배경에 따라 나름의 교육정책을 도입․추진하고 있다. 하지만 사회적 법치국가의 등장으로 말미암아 교육정책은 보다 적극적인 형식을 취하게 되었고 이는 ‘교육복지’라는 형태로 보다 구체적으로 구현되게 되기에 이른다. 하지만 복지 정책의 경우 그 유형과 실현 형태가 다양할 뿐만 아니라 국가의 재정이 뒷받침되어야 하는 정책이기 때문에 교육복지와 관련된 정책 수준을 정하는 것이 가능한 것은 아니다. 헌법재판소가 사회복지 정책 관련 법안을 심사하는 데에 있어 ‘과소금지의 원칙’을 채용하는 등 입법자의 입법형성권을 상당히 광범위하게 인정하고 있는 것은 그와 같은 이유에서이다. 하지만 그렇다고 하더라도 사회적 법치국가의 도래 이후 복지의 수준이 고양됨에 따라 교육 복지의 수준 역시 제고될 필요성을 부인할 수는 없는 것이고 이에 대한 논의를 위하여 교육복지 관련 정책을 모범적으로 운영하고 있는 국가들의 사례를 참고할 수 있을 것이다. 교육 정책에 대한 관심이 급기야 교육복지 정책에 대한 관심으로 확장되고 있는 우리의 경우에도 당해 사항에 대한 논의의 필요성을 부인할 수는 없다. 특히 복지 정책을 비교적 성공적으로 추진하고 있는 노르웨이의 교육복지 정책과 관련한 경험은 우리에게도 시사하는 바는 결코 작지 않을 것이다.
Abstract
Many states adopt and implement the policy and legislation concerning with the education according to their own political, social and cultural background for the sake of the importance of education. Furthermore as the state became a social law-abiding country, it is obligation for states to boost the policy relating to education in the name of “Education Welfare.”However when it comes to the education welfare policy, there are a great deal of forms of education welfare to realize the concerned policy according to the political and social background and the policy demands the finance to some extent, it is difficult to define what desirable or optimal extent of education welfare is. Therefore, Korean Constitutional Court adopts the principle of “minimum protection”relating to the protection of social right in order to admit the broad discretion to legislate by law-makers. However, as it is necessary to enhance the level of welfare with the advance of a social law-abiding country, so it is obligation of states to boost the level of education welfare accordingly. And we can refer to various education welfare policies of other states. In other words, we also need to discuss this education welfare in order to secure our own education welfare. In particular, we are able to refer to the experience, policy and legislation of Norway concerning with the education welfare, due to the fact that Norway is said to be successful in implement the policy concerned the education welfare.
