제주특별자치도 특별법의 개선과제

초록
제주특별자치도제가 실시된 지 7년째에 접어들었으나, 비판적인 문제들이 제기되고 있다. 제주주민들의 입장에서는 기초자치단체의 폐지로 인한 주민자치권 축소와 이를 대신한 행정시의 책임소재의 부재 등 여러 가지 바뀐 환경 때문에 주민행정의 대부분이 도청으로 집중되는 현상과 특별자치제실시 이후에도 제주지역의 사회ㆍ경제적 여건이 별반 달라진바가 없는 등 가시적이 효과가 없이 사회ㆍ경제적인 역량이 제주시에 집중되는 현상이 별반 반가울 것이 없다는 입장이다. 이러한 현상은 제주도청에 자치권한이 집중되었다는 이유로 책임을 회피하는 제주행정시에 대한 시민들의 불만과 제주특별자치도 도의회의원 선거구 책정에 대한 추자도 및 우도 주민의 도의회 선거구획정에 대한 의의제기에서도 찾을 수 있다. 이러한 문제들을 해결하기 위해서 본 논문에서는 우선 제주특별자치도 출범 이후에 이루어지고 있는 중앙정부의 권한이양 방식 즉 사안마다 개별적ㆍ열거적으로 중앙행정기관의 장의 권한을 도지사의 권한으로 이양하거나, 도 조례에 위임하는 방식에서 제기되고 있는 정책적 사안들을 분석하고 개선방안을 제시하였다. 이러한 권한 이양방식때문에 제주특별법은 400여개 조문을 가진 방대한 법률이 되었고, 한 부분의 권한이양을 위해 관련 법률들을 하나하나 살펴보고, 개별적으로 모두 개정해야 하는 형편이다. 앞으로도 제주특별법의 개정이 계속 예정되어 있기 때문에 개정될 조문 수는 증가할 것이고, 제주특별자치도에 적용되는 제주특별법의 체제는 더욱 복잡해질 것이다. 이러한 관점에서 제도시행에 대한 문제도 제기되고 있다. 특히 특별자치제의 활성화를 위해 장애가 되는 제도들과 법적인 문제들은 많으나, 자치권확대를 위한 헌법적, 법률적 권한확대와 자치경찰 문제는 매우 중요한 개선과제로 볼 수 있다. 또한 법조문의 형식도 예외를 인정하고자 하는 법률의 조문들을 일일이 열거하는 방식으로 작성되어 있다. 결론적으로 제주특별법은 주민들이 이해하기 쉽도록 같은 성격을 가진 조문끼리 모아 분법하고, 알기 쉽도록 법률체제정비와 더불어 용어를 개선할 필요성이 있다. 또한 제주특별자치도의 이름에 걸맞은 자치권의 확보를 위하여 헌법적 근거를 마련해야할 필요성이 있으며, 제주특별법의 효력을 다른 법률보다 우선시하는 법적근거도 마련할 필요가 있다. 그리고 우리나라 지방자치제의 입법권을 제한하는 지방자치법상의 ‘법령의 범위 안에서’라는 조항의 특례를 제주특별법에 규정하여 자치입법권의 확대에 기여해볼 수 있다. 또한 자치경찰제도도 개선하여 자치경찰관이 경찰로서의 기능을 수행할 수 있는 근거를 마련하여야 한다.
Abstract
Remodelling issues in the Special Act of Jeju Special Self-Governing province The aim of this research is to understand issues in the Special Act of Jeju Special Self-Governing province. Seven years after introduction of special self-governing system to Jeju Island is going on, critical issues have been raised. From Jeju residents' perspective, reduced autonomy of residents due to the abolition of local governments and changes in the environment of the administration, such as the absence of several administrative responsibility make most of the population concentrated in a special municipality of Jeju Island. After the development of administrative system social and economic conditions are still not changed without visible effect. To solve this problem, in this paper, political issues is discussed. In other words, the regulations or mandate is chosen to be the way separately for each issue by way of transfer of central government's authority to the Jeju. To do that, the Jeju Special Act is huge with over 400 provisions. To revise a part of the rights, it needs to look at the relationship between law and individual circumstances one by one. In the future Jeju Special Act will be amended because it is expected to continue to increase the number of revision. The applicable law and the system will be more complex. In this sense, the problems of enforcement are also raising. For the system improvements, it is challenged to resolve legal issues for expanding constitutional and legal rights and improvement of municipal police, especially now between the government authority and a special municipality.
