초록
현재까지 우리나라는 재외국민보호를 위한 기본법이 제정되지 않은 채 외교부훈령과 기타 주변 법률에 의거한 보호에 그치고 있어서 해외 체류 중에 각종 위난에 처한 재외국민이 국가로부터 시의적절하고 온전한 보호를 받지 못하는 실정이다. 2013년 기준 세계경제 순위가 15위에 해당하는 경제력, 세계화라는 당면한 현실, 연간 1천만명이 넘는 해외여행객 그리고 해외에 거주하는 재외 동포가 700만 여명에 이르렀음에도 불구하고 국가의 재외국민보호 의무를 구체적으로 규정하고 있는 법률의 부재로 인해 실효성 있는 재외국민보호가 이루어지지 않고 있다. 이것은 헌법상 보장된 국민의 권리가 보장받고 있지 못 함을 의미한다. 이와 관련하여 헌법재판소는 “헌법 제2조 제2항에서 정한 국가의 재외국민 보호 의무는 … 거류국과의 관계에서 국가가 하는 외교적 보호와 국외 거주 국민에 대하여 정치적인 고려에서 특별히 법률로써 정하여 베푸는 법률ㆍ문화ㆍ교육 기타 제반영역에서의 지원을 뜻하는 것”이라고 판시한 바가 있다. 즉 국가는 해외에서 재외국민이 처하게 되는 각종 사고와 위난에 대한 구체적인 보호의무의 규정 및 보호체계의 확립을 통한 재외국민의 생명과 재산을 보호하고 더 나아가 국민의 보다 안전한 해외활동 보장을 위해 재외국민보호에 관한 기본법의 제정이 절실하다.
Abstract
Because protection of Korea toward overseas residents is limited to the protection that is based on ministry of foreign affairs instruction and other related law without Framework Act for protection of overseas resident, overseas residents who are faced with various danger during stay abroad are receiving timely and intact protection. Despite world rank 15th economic power, according to the data of 2013 ,trend of globalization, overseas travelers of over 10 million a year and about 7 millions of overseas Korean living abroad, because of absent of law which prescribes duty of nation concretely effective protection of overseas resident is not done. This means the fact that people's right is not assured. In this connection, the Constitutional Court judge " Under the Constitution Article 2, Paragraph 2 duty to protection of overseas resident of nation … means support at law‧ culture‧ education and other area acting by legislating law specially through diplomatic protection of nation and political judgement considering the relation with resident country". In other word, the nation should establish concrete duty to protect and protection system about various accident and danger and enact Framework Act about protection of overseas resident to guarantee not only life and property of overseas residents but also safe overseas activities of people.
