ICT 특별법의 제정 의의와 발전 과제

박근혜 정부는 2013년 정보통신의 진흥과 융합 활성화를 위한 특별법을 제정하였다. 이 법은, 첫째 창조경제 및 ICT 융합 활성화의 추진체계의 역할을 하고, 둘째 미래창조과학부가 ICT정책의 총괄부서로서 역할을 할 수 있도록 한다. 셋째 이 법은 ICT의 진흥법, 특별법, 기본법의 성격을 가지고 있다. 그러나, 이 법은 몇 가지 한계를 가지고 있다. 첫째 이 법이 기존의 ICT 법제와의 관계에서 특별법으로서 실효성을 가질 수 있는가 하는 점이다. 여기서 중요한 것은 역시 정보통신 진흥 및 융합 활성화 기본계획의 수립과 그에 따른 실행계획의 수립이고, 다음으로 중요한 것이 정보통신 전략위원회의 운영이라고 할 것이다. 특히 전략위원회의 심의ㆍ의결의 절차의 효율성을 제고함으로써 동 위원회의 기능을 강화할 필요가 있다. 그리고, 무엇보다도 새롭게 구성한 신속처리와 임시허가제도의 정착 여부가 중요하다. 이 새로운 행정작용이 의도된 목적을 달성할 수 있도록 제도를 정비하여야 하고, 나아가 기존의 법률과 사이에서 빚어질 갈등관계가 해소되어야 한다.
Abstract
Park Geun Hye Government enacted a special Act on convergence activation and promotion of ICT in 2013. This Act must be able to be the role of the organization system for the activation of convergence on ICT and creative economy. and Ministry of Science, ICT and Future Planning must be able to serve as general department for ICT policy. In addition, the act have the personalities as a promotion law, special law, and basic law. However, the law have some limitations. First, how to ensure the effectiveness as a special law in relation to the old ICT legislations. What is important here is the development of the basic plan and the associated action plan. The management of information and communication strategy committee is next important.. In particular, it is necessary to enhance the functionality of the committee by increasing the efficiency of the procedures for deliberation and resolution of the strategy committee. And, the establishment of temporary license and fast track is important as anything else. The system should be developed to achieve the objectives of this new administrative action and the conflict that is generated with the existing laws should be eliminated.
