북한의 노인복지 법제 분석- ‘년로자보호법’을 중심으로 -

South and North Korea are all facing an aging problem which is just a real issues approach to the main governmental project, it will stand the aged welfare problem of a unified Korea. Especially, the aging problem in North Korea is still difficult to unify the country's social integration, it is clear that the challenge be filed. So the analysis of real welfare of the elderly and identification related to legislative of North Korea is to one of the leading issues in considering future initiatives of a unified Korea. In unification of the two Koreas, the integrated system of the elderly will be a very important task for social integration. That is, the analysis on situation and process of the aging population in North Korea be stressed the need for detail beyond attention of it. North Korea raised the severity of the problem of aging population, stressed the urgency for its measures. And this analysis and interest shows the problem of aging population is a serious social problem, become a national challenge in North Korea. North Korea's aging population eventually will be a very important issue as the inevitable process of social integration in a unified Korea. Because elderly population increases, the burden of the unification costs may be weighted. But on the other hand the cost may be reduced by a proper precautions. In this study, it is important to find that how developed the aging problem and what is its own measures of North Korea before looking at the status and characteristics of the aged welfare legislation of North Korea. In addition, it analyzed the legal framework based on North Korean constitutional law, and the ‘Elderly Person Protection Law’ as the relevant laws of the elderly person with respect to the related to legislation of the aged welfare. And the contents of the elderly welfare law of North Korea be analyzed through the comparison of the elderly welfare law of South Korea. North Korea emphasizes on free of medicare charge for the elderly and the state social insurance and social security. However, we can see a very vulnerable situation of the elderly welfare because of harsh conditions of North Korean economy. In fact, the social welfare institution in North Korea has big gaps in the system and the real our welfare system. Based on the above discussion, this study is to analyze the actual situation, content and features of the aged welfare-related laws of North Korea, but it is to consider the limitations and challenges of that.
