하트 법철학의 분석적 방법론과 형이상학

초록
본고는 하트의 법철학이 취하는 분석적 방법론의 의의와 특질, 그리고 그 형이상학적 함의의 일단(一端)을 밝히고자 한다. 하트의 분석적 방법론은 그의 활동 시기에 따라 다소의 변천을 겪어 왔다. 그의 초기의 방법은 전통적인 정의(definition)의 방법과는 뚜렷이 구별되는, 해명으로서의 정의에 해당한다. 그러나 그의 방법은 적어도 <법의 개념>에서부터는 법적 언어들의 용례에 주목하는 언어분석의 작업이며, 이러한 언어분석은 비환원적인 성격의 분석이다. 나아가, 하트의 언어분석의 방법론이 갖는 형이상학적 함의는 철학자 잭슨(Frank Jackson)의 개념분석 구분, 즉 온건한 개념분석(Modest Conceptual Analysis)과 온건하지 않은 개념분석(Immodest Conceptual Analysis) 간의 구분의 견지에서 유용하게 조명될 수 있다. 온건하지 않은 개념분석의 경우, 개념분석이 세계의 본성을 기술해 주는 작업이라고 여기는 것으로서, 강한 형이상학적 신념헌신(commitment)을 담은 분석이다. 반면 온건한 개념분석은 언어사용자가 개념을 다루는 방식을 탐구함으로써 그 “개념”을 기술하고자 하는 데에 목표를 둔다. 이로부터 본고는 다음을 논구한다. 문헌상 하트의 언어분석 방법은 온건한 개념분석과 온건하지 않은 개념분석 양쪽 모두로 해석될 여지가 있지만, 하트의 해석학적 방법론과의 일관성을 고려할 때 그의 언어분석을 온건한 개념분석으로 해석할 좋은 이유가 있다. 다만 온건한 개념분석이 갖는 형이상학적 함축이 무엇인지는 여전히 불분명하다.
Abstract
In this paper I attempt to figure out what characteristics and metaphysical implications the analytic methodology of Hart’s legal philosophy has developed with it. According to the paper, his analytic methodology aims not at a definition in a the traditional sense but at an analysis of legal language. This analysis gives particular attention to the usage in that language and its reconstruction. The analysis is non-reductive in that it does not attempt to reduce the analysandum into analysans ontologically or semantically. Furthermore, I discuss the metaphysical implications of Hart’s method of linguistic analysis, pointing out that this method is construed as analogous to Frank Jackson’s sophisticated theory of conceptual analysis. I then proceed to show that the method is compatible with both of the two versions of conceptual analysis posited by Jackson, Modest Conceptual Analysis(MCA) and Immodest Conceptual Analysis(ICA). In conclusion, I claim that although the metaphysical implications of MCA are still unclear, Hart’s whole methodological project would be more coherent when interpreted as in line with MCA rather than ICA.
