전자선화증권의 법률적 모델분석에 관한 연구

초록
볼레로 선화증권이 도입되면서 전자선화증권의 상용화 기대가 높았지만 볼레로 서비스는 법률적 지원 부재 등의 이유로 그 성과를 거두지 못하였다. 즉, 볼레로 선화증권의 경우에도 법률적 문제점을 해결하기 위해 볼레로 규약집을 만들어서 임의규칙으로서 당사자들간의 합의로 적용될 수 있도록 하였지만 거의 실패로 종결되고 있는데 이는 각 국가의 법률에서 전자선화증권이 법적 효력을 가지지 못한 한계성에서 기인한다고 볼 수 있다. 이와 같이 법률적인 배경없이는 전자선화증권의 도입이 현실적으로 불가능하다는 것을 인식하면서 각 국가와 UNCITRAL에서는 전자선화증권의 도입을 위한 법률과 협약을 제정함으로써 법률적 모델들이 도입되고 있다. 호주의 데이터메시지 모델, 미국의 전자권리증권 모델, 한국의 전자선화증권모델, UNCITRAL의 유통가능 전자운송기록모델 등이 법률적 모델로서 도입되고 있다. 제도적 모델은 이미 선행적으로 연구되었기 때문에 따라서 본 논문은 연구의 범위를 전자선화증권의 법률적 모델에 한정하고자 한다. 따라서 본 논문은 이러한 전자선화증권의 법률적 모델을 분석하고 그 시사점을 도출하여 전자선화증권의 국내외 활용을 제고하는데 그 연구목적이 있다.
Abstract
After adoption of Bolero Bill of Lading, there was high expectation of commercialization of e-B/L. But Bolero B/L has not good result because of absence of legal support. Bolero RuleBook was adopted by parties as a voluntary rule to settle the legal problems regarding Bolero B/L, but Bolero B/L almost came to failure because e-B/L doesn't have legal effect in the laws of each nation. By recognizing the fact that the adoption of e-B/L is impossible without legal background, each country and UNCITRAL are adopting legal models by enacting laws and convention for adoption of e-B/L. Australian data message model, American electronic document of title model, Korean e-B/L model and UNCITRAL's negotiable electronic transport record model have adopted as legal models. Thus, this paper would set limit to the legal models of e-B/L as the system models are already studied and the purpose of this paper is to contribute to the improvement of internal and external utilization of e-B/L by analyzing the legal models of e-B/L and drawing its implications.
