The Liability Scheme and Nuclear Accident -Lessons from Fukushima-

The purpose of this paper is to analyze the Japanese nuclear liability regime revealed from the process of that of the Fukushima Nuclear Plant Accident, and to provide just, reasonable, and affordable lesson for Korea’s nuclear regulatory system that has similar nuclear power generation system. The goal of the liability regime ranges from not only ex-post victim relief programs, but also to ex-ante deterrence efforts are outstandingly important, especially, from the aspect of efficiency improvement of the relief system. As being said, we can rationally consider Mutual Support Scheme and/or property insurance program which is co-linked with underwriting ability to accept in addition to liability insurance itself only as well as current channeling of liability scheme that the electricity Utility, KHNP, only is responsible for accident. Along with above relief and insurance programs, we need rapid discard of the Act on Indemnity Agreement for Compensation of Nuclear Damage, which implicitly or explicitly obstructs a nuclear operator’s efforts to deter accident. Because this agreement indemnify a nuclear operator for any losses arising from the compensation nuclear damage which cannot be covered by private liability insurance contract, in exchange for payments of indemnity fee which is only one-twenty three of insurance premiums. On the other hand, in order to prepare for joining in CSC convention, I offer some suggestions that Korea’s nuclear liability regime should resolve in near future such as the abolition of the limitation of liability in amount.
