The courts or investigative agencies need to understand 'technology' to some extent in order to solve disputes regarding Trade Secret. However, in reality, they are having difficulty in judging the validity or infringement of Trade Secret due to lack of knowledge of technology. Therefore, Public Expert Service System needs to be established in an attempt to support the courts or investigative agencies in adjudicating on main disputes concerning Trade Secret. This research studies ways to set up a professional and reliable Public Expert Service System on the basis of the distinct characteristics and technology involvement of Trade Secret disputes. For example, Public Expert Service System requires an expert witness pool including technical experts considering accuracy, fairness, economic feasibility and security maintenance.
