Family is the most fundamental unit in any society. In some aspect, dispute in the domestic relations is inevitable because family is also one of the human societies. The wavelength of a domestic dispute is much greater than in civil case. Since 2000, there have been significant changes in the field of domestic relations. Among those changes, abolitions of household system and of the ban on the same surname and same origin marriage are the most significant. Since 2000, domestic relation disputes are increasing. The main reason of the increase is lots of the judicial divorce cases. The purpose of this article is trying to understand what types of domestic relation dispute happen frequently, and what law should apply to judicial divorce cases among the positive law.
