국문충돌손해배상책임특별약관의 법적 문제에 관한 고찰

초록
선박충돌은 침몰, 좌초, 좌주, 화재와 같이 5대 해상위험 중의 하나이다. 중앙해양안전심판원이 발표한 최근 5년간(2008년∼2012년)의 해양사고 발생현황을 보면 선박충돌이 전체 해양사고 3,612건 중 824건으로 전체 해양사고의 22.8%를 차지하고 있어 선박충돌이 중대한 해양사고의 하나로 파악되고 있다. 선박충돌은 선박의 해양사고 중에서도 자선뿐만 아니라, 상대선박과 관련하여 여러 가지 문제들을 해결해야 하는 경우가 많고, 또한 손해액도 거액이 발생하는 경우가 많다. 따라서 선주는 자신의 선박자체에 발생하는 물적 손해를 보상하는 선체보험(공제)과는 별도로 선주가 선박충돌로 인해 배상할 손해를 보상하는 이른바 충돌손해배상책임보험(공제)에 가입할 필요가 있다. 현재 충돌손해배상책임위험은 내항선의 경우에는 한국해운조합이 제정한 국문형태의 충돌손해배상책임특별약관에 의하여 인수되고 있다. 따라서 이 논문에서는 국문충돌손해배상책임약관을 중심으로 약관해석상의 법적 쟁점사항에 대하여 검토한 후, 이에 대한 개선안을 제시하고자 한다.
Abstract
Vessel collision is one of the five biggest maritime perils with sinking, stranding, grounding, and fire. According to the record of marine accidents for the last 5 years (2008∼2012) published by Korean Maritime Safety Tribunal vessel collision account for 22.8% of total marine accidents as 824 cases out of 3,612 cases in total. Therefore, it is identified that vessel collision is a grave marine accident cause. In many cases related with vessel collision, problems relating not only with the vessel but also with another vessel should be resolved and damages can be huge. Therefore, ship owners need to subscribe a collision liability insurance(mutual insurance) to compensate for damages by vessel collision in addition to hull & machinery insurance(mutual insurance) compensating for physical damages on their own vessels. At the moment, collision liability risk of Korean coastal vessels is covered by Korean version collision liability clause enacted by Korea Shipping Assurance. Therefore, in this paper, legal issues in interpretation of the insurance policy are reviewed focusing on Korean version collision liability clause and improvements are proposed.
