개혁개방 이래 중국은 눈부신 경제성장을 이루어 괄목할만한 성과를 실현하였고 2012년 현재 전세계 231개 국가 및 지역과 활발히 무역활동을 전개하고 있는 명실상부한 무역대국으로 성장하였다. 중국 시장의 화려한 발전은 세계무역경제의 활성화 및 글로벌화에 긍정적인 기여를 한 반면 신속한 경제성장에 수반한 국제무역거래 관련 분쟁의 급증을 야기하였다. 이러한 현상은 지역적 및 다국적 차원의 효율적이고 합리적인 분쟁해결시스템의 구축을 시급히 요구하고 있다. 따라서 이는 안정적이고 지속적인 세계무역경제발전에서 간과할 수 없는 주요한 과제로 부상되었다. 이 논문에서는 위와 같은 과제에 주안점을 두고 중국기업과 무역거래를 활발히 진행하고 있는 외국기업 등 경제주체 사이에 흔히 발생하는 국제무역분쟁의 해결방식과 관련하여 현행 중국법제시스템을 전반적으로 소개하고자 한다. 이와 함께 중국 현행 사법실무를 전제로 무역당사자들이 실무적으로 중국 또는 기타 무역상대국에서 소송 또는 중재 관련 분쟁해결방식을 합의 선택할 때 보전조치 및 집행의 가능성 방면에서 미리 인지하거나 유의해야 할 사항들을 제시하여 법적 리스크를 감소시키는 방안을 찾아보고자 한다. 또한 국가간 무역경제의 지속적인 발전을 위해 현재 분쟁해결시스템에서 시급히 개선되어야 할 문제점을 제시해보고자 한다.
Abstract
China has made remarkable achievements in economic development since its opening to the outside world in 1978. In 2012, China is trading with 231 countries and regions all over the world. China truly became one of the trade giants. The splendid development of Chinese market is greatly contributed to the invigoration and globalization of world trade, thereby it also brings about a surge of trade disputes related with China. As a result, for the stable and sustainable development of international transactions, it is urgent to establish an efficient and rational dispute resolution system for such cross-border disputes. Focusing on the above problem, this paper provides an overview of current Chinese legal system for the resolution of international transactions and also discusses some problems relating to the possibility of preservation measures and execution when the parties choose a certain dispute resolution method such as litigation or arbitration, either in China or in the trading partners’ country. In addition, the paper points out some problems which need to be solved urgently in the current dispute resolution system related with China to reduce the legal risks and promote the sustainable development of international transactions.
