비채변제에 관한 개정제안 - 2009년 민법개정위원회에서의 논의-

2009년에 출범한 법무부 민법개정위원회에서는 비채변제에 관하여 제742조(비채변제) 한 조문과 관련하여 그 표제를 “채무없음을 알고 한 비채변제”로 수정하고, 본문에 ‘임의로’라는 요건을 추가하는 개정제안을 확정하였다. 본문에서 임의성 요건을 추가한 것은 현행 통설과 판례의 태도를 반영한 것이고, 표제를 수정한 것은 비채변제 규정(742조~745조) 전체의 체계를 고려하였기 때문이다. 본고에서는 이와 같은 개정제안의 취지 및 개정제안이 확정되기까지의 논의를 구체적으로 소개하였다. 비채변제에 관한 제742조는 (본고에서는 검토하지 않았으나 이번에 개정제안으로 확정된) 제746조(불법원인급여)와 더불어 실무에서는 상당히 의미있는 조문으로 활용되어 왔다. 이번에 확정된 2009년 민법개정위원회의 개정제안에서는 (양조문 모두) 변제자 구제에 보다 유리한 방향으로 요건을 재조정하게 되었다. 물론 통설ㆍ 판례의 입장을 반영한 것이기는 하지만, 이러한 개정제안이 실제 개정으로 연결될 경우 이후의 실무에 미치는 영향이 결코 적지 않을 것이라고 생각한다. 또한 이론적으로도 특히 제742조의 표제를 수정한 것은 ‘비채변제’ 자체의 이해를 포함하여 비채변제 규정 전체의 체계적 이해를 위한 시도로서 의미가 있다고 생각한다.
Abstract
Civil Code Revision Committee 2009 decided to propose the revision of article 742 (discharge without obligation). The proposal changes the title from ‘discharge without obligation’ to ‘discharge without obligation getting aware that there is no obligation’, and adds one word ‘discretionally’ to the article. The committee added ‘discretionally’ to the article reflecting common view and case law, and amended the title considering the legal system of ‘(in a broad sense) discharge without obligation’. This paper introduced the point of proposal of revision and the discussion about the proposal at the committee concretely. Article 742, with also article 746 (performance for illegal cause), has been used as very meaningful methods for the person who has performed without obligation or for illegal cause. The amendment on both articles proposed by the committee would regulate clearly in favor of the person who has performed without obligation or for illegal cause. Although this change reflects only common view and case law, when the proposal realizes, the impact on trial business would be very huge.
