한국·미국·일본의 장애인체육 관련 법률적 기반에 관한 연구

초록
본 연구는 한국, 미국, 일본의 장애인체육 발전의 영향을 주었던 법령들을 탐색하고 이를 비교․분석함으로써 법령 변천과정에 따른 장애인체육 발전과정의 특징과 의미를 도출하는 것이 목적이다. 본 연구의 목적을 달성하기 위해 한국 10개, 미국 9개, 일본 7개의 장애인체육 관련 법률 원문과 각 국의 법률제정 및 개정과정과 관련 있는 문헌자료 13개를 연구 자료로 선정하였다. 연구 방법은 귀납적 범주 분석 가운데 내용분석(Content Analysis)을 실시하였으며 분석과정을 통해 14개의 하위범주어와 4개의 상위범주어, 4개의 핵심주제어를 도출하였다. 분석과정에서 도출된 하위 주제어들의 연구자 주관성을 제고하기 위해 특수체육 전공 교수 1인, 특수체육 전공 박사과정 1인, 석사과정 1인과 협의하는 동료자간 검토를 실시하였다. 본 연구를 통해 최종적으로 “장애인, 한 명의 시민으로 살아가기”, “장애인체육의 기초 터 닦기”, “장애인체육 유관기관과 함께하는 도약의 달음질”, “통합의 메시지와 질적 발전을 추구하는 장애인체육”이라는 4개의 핵심주제어를 도출하였고 우리나라 장애인체육이 통합적 가치를 구현하기 위해 장애인·비장애인의 경기종목 및 체육 전담기관 간 통합, 그리고 장애인체육의 내·외적인 정당성 확보를 위해 명확하고 구체적인 정의의 수립이 필요하다는 것을 확인할 수 있었다.
Abstract
The purpose of this study was to find out the characteristic and meaning of development process of disability sport by investigate and compare the law which had an effect on the improvement of disability sports in Korea, United States and Japan. 26 original law and 13 research data from cases of 3 countries were collected related with disability sport. 14 of sub-categorical words, 4 of super-category words and 4 core words were emerged by contents analysis. To guarantee reliability of this research peer-review was performed. Finally 4 core words were extracted: ‘the handicapped, live as one of the citizen’, ‘establish the foundation of disability sport’, ‘make a leap forward with disability sport organization’, ‘the message of integration and qualitative development'. Lastly, for the future of disability sport in Korea, unified system between disabled or non-disabled sportorganizations and detailed law about disability sport is required to realize the value of integration and to strengthen performing disability sport in school and field.
