담합 자진신고자 감면제도와 손해배상의 법적 쟁점

초록
리니언시는 카르텔 참여 사업자들이 위반내용을 스스로 신고하고 카르텔의 붕괴를 조장함과 동시에 제재를 감면 받기 때문에 사업자에게는 중요한 인센티브로 작용하고 있고, 법 집행당국으로서는 카르텔에 관한 직접적인 입증자료를 확보하는 데에 매우 효과적이라고 판단되기 때문에 적극적으로 활용되고, 그 활용도는 점점 늘어나고 있다. 한편으로 담합에 대한 피해를 받은 소비자를 보호하기 위하여 손해배상 소송이 활성화되어가고 있다. 그 경우에 리니언시 제출 자료를 민사소송에서도 손해의 입증 자료로 사용할 수 있다면 손해배상을 청구하는 소비자의 입장으로는 담합 여부 및 손해를 입증하기가 매우 쉬울 것이지만, 반면에 피해를 배상하여야 하는 사업자의 입장에서 보면 매우 불리할 수 있을 것이어서 이들의 이해관계 조정이 필요하다. 미국과 EU에서도 카르텔을 적발하기 위한 리니언시의 실효성을 담보하기 위하여 다소간의 공개 제한이 이루어지고 있는 점을 고려하면 리니언시로 획득한 자료를 민사소송에서 원용하는 것은 한계가 있다고 볼 것이다. 공정위가 소비자와 리니언시 수혜자, 그리고 리니언시 수혜자 외의 다른 담합 참가사업자의 이익을 형량하여 어느 선까지 어떠한 절차로 공개하여야 하는지에 대한 명확한 법적 기준 마련이 시급하다고 할 것이다. 또한 리니언시 수혜자가 행정적 책임을 감경받았기 때문에 손해배상 책임도 감경해주어야 한다는 것이 이론적으로 가능한 주장일 수 있으나, 리니언시의 실효성을 해치지 않는 차원에서는 행정적 책임은 민사적 책임과 분리하여 생각할 필요가 있다고 판단된다.
Abstract
Leniency is evaluated effective material to reveal hardcore cartels, which are very difficult to find out, because KFTC gives full immunity to first leniency applicant in terms of the administrative surcharge. If a consumer, who becames some financial damages from the illegal cartel, wants to sue the private action, can he apply to all evidence document, which are submitted or produced by the leniency applicant? We should consider the interest of the business secret of the applicant. The leniency materials should not be disclosed in any way during the procedure of the KFTC and the courts to plantiff. It is important to keep this system as a means of preventing somewhat self-incrimination. The KFTC and the court should make a legal standard which rules the process and the creteria of the cooperation and limitation about disclosure of such leniency material. And in spite of the effectiveness of the leniency to the public enforcement, it should not be reached unconditionally that leniency can immune all criminal sanction as well as civil damage.
