인권경영을 둘러싼 이론적 쟁점

This article is dealing with the issues of business and human rights, which emerged as one of the new human rights issues since mid-2000. In particular, this article is paying attention to some theoretical issues on business and human rights. In this article the author is focusing on four main issues. First, why should companies comply with human rights management? Second, how is human rights and social responsibility management to differentiate? Third, what is the human rights theory required to argue business and human rights? Fourth, which way and measures of regulating human rights management should we choose to ensure effective regulating business and human rights? About the first issue, this article pays attention to social and public nature of corporations and the limits of compliance management(II). About the second issue, this article points out by using political philosophical perspective that human rights management is liberal whereas social responsibility management is communitarian(III). About the third issue, the author gives the systems theoretical human rights theory of Gunther Teubner as a theoretical solution(IV). About the fourth issue, this article criticizes the self-regulatory measures of John Ruggie, and proposes the measures of acculturation as well as transnational human rights regime(V).
