소수자의 차별 분석과 소수자 권리 보호 위한 통합적 접근

초록
이 논문은 소수자의 개념, 소수자의 차별 원인 등에 대하여 체계적으로 연구하고, 그에 기초하여 소수자의 권리를 보호하기 위한 법교육의 방향을 제시하는 것이다. 소수자는 사회적 가치와 자원의 분배에서 그것을 소유하지 못 한 사람들이나 집단이다. 소수자는 인종적·민족적, 사회적, 경제적, 신체적, 종교적, 사상적 소수자로 분류될 수 있다. 소수자의 배제와 차별의 심각성은 특정한 개인이 아니라 집단, 민족, 인종 전체에 대해 부당하게 차별이 가해진다는 것이다. 이런 소수자의 배제와 차별은 잘못된 편견이나 고정관념에 기초하고 있다. 소수자의 배제와 차별은 구조적으로 제도화되고 관습화되어 있다. 그러므로 소수자의 차별을 없애고 기본 권리를 보호하기 위해서는 소수자 차별을 금지하는 법과 제도를 만드는 것도 필요하고, 다른 한편 잘못된 편견을 제거하고 소수자 권리를 인정하고 공생하도록 하는 법교육이 요구된다. 따라서 법교육에서 ‘소수자 차별 금지와 권리 보호’를 명시하고, 소수자 반편견 교육, 소수자 정체성 교육, 소수자 권리 교육, 소수자 관용 교육 등을 실시해야 한다.
Abstract
This paper aims to study on the law of protection for minority and on the directions oflaw-related education(LRE) to protect rights of minority. The minority are those who do not have a social values or resources and subsequently are discriminated unreasonably by majority in social life. The minority can be classified by a race or ethnic, social status, capitals or socio-economic class, physical status, religion and thought. Traditionally women, the disabled, working classes, foreign immigrants are classified as minority. The exclusion and discrimination of minority is orginated in groundless prejudice or a fixed idea of majority. Therefore we should reform law and institutions to eliminate discrimination of minority and reinforce LRE to protect rights of minority. The LRE for minority consists of anti-bias education for minority, education for identity of minority, education for rights of minority, education on toleration of minority.
