초록
우리나라 헌법의 기본정신에 비추어보거나 외국의 입법례와 그에 관한 판례들을 살펴볼 때, 우리나라도 입법이나 법원의 판례 혹은 행정상으로 성주체성 장애를 가진 자가 성전환수술을 시행한 경우에, 그 전환한 성에 적합한 사회생활을 할 수 있도록 배려하여야 할 것이다. 우리나라도 최근에 이르러서 극소수이지만, 일상생활이나 사회생활을 잘 적응할 수 있도록 배려하는 사례도 몇 가지 볼 수 있다. 그러나 아직도 성전환자에 대한 일반인의 편견 등 현실적으로 어려운 문제점이 있기 때문에 더 이상 진전되지는 못하고 있다. 이러한 사람들의 직업이나 결혼문제 등 독일 사례에서 볼 수 있는 것처럼 우리나라도 이 문제에 대하여 인간의 존엄이나 행복추구권을 보장하고 있는 헌법수준으로 논의를 할 필요가 있다. 그렇지만, 앞서 서술한 성전환자의 성별정정허가신청사건 등 사무처리지침처럼 자식이 없는 것을 조건으로 하는 등 그 구제범위는 반드시 넓다고 볼 수 없다. 또한 세상에는 성주체성 장애 단계까지는 이르지 못하더라도 이러한 고민을 포함해서 사회생활면에서 말 못할 사연을 안고 꿋꿋하게 살아가는 사람들도 많다. 이러한 점을 고려하여 향후 입법화할 때 요건 등을 완화시키는 방향으로 검토해야 할 것이다. 그리고 일반적으로 제출문서에 성별란(性別欄) 기재는 반드시 필요한지 여부 등을 검토해야 할 것이다. 이러한 소수 사람들도 가슴을 활짝 펴고 살아갈 수 있도록 사회적 이해와 사회적 공감대가 형성될 수 있도록 여러 제도적(입법론) 보완장치가 적극적으로 요구된다고 할 것이다.
Abstract
In recent times, attention to the sexual minorities is increasing in our society. Among them, above all, medical and legal problems about transsexuals have been emerged as core problem at home and abroad. This research paper is mainly handling these problems.＊The commission on verification and support for the victims of forced mobilization under Japanese colonialism in Korea, Investigator. In the legal and medical point of view, Sex-Reassignment Surgery must be permitted in the restricted and medical-matching conditions, and the rights of transsexuals must be protected from standpoint of human dignity and pursuit to happiness promulgated in our Constitution. Nowadays, the prejudice about sexual minorities has been gradually eradicated in our society. But the discrimination and bias is still in existence insidiously. this irrational way of thinking must be reformed to guarantee the rights of transsexuals. In this society, there are many people that live earnestly in spite of various sexual problems which are not, in the conventional meaning, generally accepted. It should be necessary to enact to protect those people, and develop and form a social consensus for the sexual minorities to lead a fair and unshrinking life. Mature society should respect each person's individuality. In this point of view, each person's sexual characteristics must be also protected. this is key factor of democratic society, at the same time, Constitutional demand.
