디지털 저작물과 권리소진 원칙－EULA 해석과 Forward-and-Delete를 중심으로

유형의 저작물을 전제로 하여 자원의 재분배 기능을 수행하여 온 권리소진 원칙은대부분의 저작물이 디지털화된 현대 사회에서 그 존폐의 기로에 서 있다. 대부분의 IP기업들은 디지털 저작물의 무한 복제 가능성 때문에 DRM 개발을 시도하면서 EULA를 통해 저작물에 대한 통제권을 계속 유지하려고 한다. 반면 이용자들은 유형의 저작물이든 무형의 저작물이든 일단 정당하게 구입한 저작물의 대여나 처분은 이전처럼 자유로워야 한다고 주장하고 있다. 저작권자의 권리와 이용자의 권리는 항상 긴장관계에 있어 왔으며 권리소진 원칙은 그 경계에서 지난 100년간 이용자들의 저작물에 대한 접근성을 보장해 주었다. 저작물에 대한 접근 환경이 달라졌다고 하더라도 권리소진 원칙은 본래적 역할을 유지하여야 한다. 유형물을 기반으로 하는 디지털 저작물은 EULA의 엄격한 해석을 통해여전히 권리소진 원칙을 적용하여야 하며, 유형물이 필요 없는 경우에도Forward-and-Delete 시스템을 구축하여 이를 전제로 권리소진 원칙을 적용하여 이용자간 거래가 자유롭게 가능하도록 하여야 한다. 그리고 완전한 디지털 체제로 이전할경우를 대비해서 여럿의 이용자들이 하나의 계정을 공유하여 저렴하게 디지털 저작물에 접근 할 수 있는 통로도 마련하여야 한다. Forward-and-Delete와 계정공유는 일부IP기업에서 자사의 정책에 따라 이루어지고 있는데 저작권자 및 이용자들의 법적 안정성과 예측가능성을 위해 관련 법률에 최소한의 요건과 효과를 명문화할 필요성이 크다고 보인다. 본고는 EULA 해석과 관련하여 외국의 여러 판결과 MS의 차세대 비디오 콘솔인 엑스박스 원 정책을 검토하였으며 동시에 Forward-and-Delete 시스템과 계정공유의 도입필요성을 강조하였다.
Abstract
The First Sale Doctrine, which plays a role in distributing the resources with regard tothe tangible works, faces the possible death in the modern digital world. Most of theIP(Intellectual Property) corporations attempt to control the works through EULA(End User Licence Agreement) developing the DRM(Digital Rights Management) because of the possible unlimited duplication of the works. On the other hand, users argue that they should have the rights to freely lend or dispose of the works that they justly bought, whether they are tangible or intangible works. There has always been tension between the copyright holders’ rights and the users’ rights and the First Sale Doctrine facilitates the user’s approach to the copyrighted works during the last 100 years. Even though the environment surrounding the copyrighted works has been changed, the First Sale Doctrine should continue to play an original role. For the tangible digital copyrighted works, the First Sale Doctrine should still be applied by strictly interpreting the EULA, and for the intangible copyrighted works, the free transactions between the users should be guaranteed by building the Forward-and-Delete system and then applying the First Sale Doctrine. In preparation for the upcoming total digital world, the scheme under which the several users can share one account and can more cheaply access to the digital copyrighted works is necessary to build. Now some IP corporations have their own policy to have the Forward-and-Delete System and Account Sharing System. To guarantee the legal stability and future predictability, the minimum guideline should be articulated in the relevant statutes. I review the several cases of the foreign countries and Microsoft’s X-box One, thenext-generation video game console and also emphasize that Forward-and-Delete system and the Account Sharing need to be adopted in this article.
