A firm continues to carry on business during reorganization proceeding. Although injunction order freezes the enforcement rights of creditors against the firm's assets and effectively extends the maturity of outstanding debt, the company must finance its continuing operations and investments. Because the firm have no additional to secured asset, it is difficulty to get funding. This paper explores, to resolve difficulties procuring postpetition financing required for the reorganization of a debtor, how to protect creditor rights in the current Korean Insolvency Act. Also this paper show a means of legal protecting origin from Corporate Restructuring Agreement, Corporate Restructuring Promotion Act ETC. To comparative law approaching, This paper investigate the Debtor- in-Possession (DIP) Financing in the US, which enables the debtor to authorize a priority over its other prepetition or postpetition creditors to the lender providing new financing.
