The Application of Monopoly Regulation and Fair Trade Act to the Labor Union and the Labor Market

Monopoly Regulation and Fair Trade Act is almost not applied to the labormarket in Republic of Korea. The labor market is not excluded in applicationlimit of Monopoly Regulation and Fair Trade Act but it is shown that thelabor market is excluded in it in practice because the labor market isregulated by labor law. However, the outsider who is a non-organizedworker, a job seeker in outside of protection zone of labor law is excluded ordiscriminated relatively because labor law plays a role to protect the insiderwho is an organized worker of the labor union. While labor’s three primary rights of labor union play a role to protect aninsider, it has increased a gap of the working conditions between the insiderand the outsider, and it has blocked the outsider to approach to the labormarket. There is no some proper method regulation to protect the labormarket order from the labor union’s abuse of rights, because MonopolyRegulation and Fair Trade Act is not applied to the labor market and thelabor union as well as an unfair labor practice system of the labor union notadopted in Korea. The labor market and the labor union lie in the blind area. As a result, it hasincreased a gap of the working conditions between the insider and theoutsider, and it has blocked the outsider to approach to the labor market. Itrequires checkup quickly the necessity of application of Monopoly Regulationand Fair Trade Act to the labor market and the labor union.

Abstract

Monopoly Regulation and Fair Trade Act is almost not applied to the labormarket in Republic of Korea.
