선박안전 및 재난관리에 관한 법정책적 검토

오늘날 과학기술의 발전에 수반된 산업구조의 고도화·복잡화로 인하여 각종 다양한 위험이발생하여 현대사회의 존속 자체가 위협받고 있다. 각종재난의 대형화, 빈발화로 국민생활의 안전에 대한 불안감이 증대되고 있고 정부의 재난안전관리 능력에 대한 국민의 기대욕구 증폭으로 재난안전관리를 전담하는 콘트롤 타워가 절실히 필요하다. 최근 청해진 해운 소속의 세월호 침몰사고와 그 대처과정을 지켜보면서 선박안전 및 재난관리시스템을 둘러싼 법제도가 마련되어 있음에도 비정상적인 사회시스템으로 인해 법집행이 적절하게 이루어지지 않고 기본이 무시되고 법과 원칙이 제대로 지켜지고 있지 않음을 알 수 있었다. 세월호 침몰사고이후 안전에 대한 국민의 기대가 높아진 상황에서 국가는 관료사회의 개혁 및 각종 사회적 비정상과적폐해소, 부정부패의 척결과 더불어 국민의 생명과 안전을 확보하는 행정시스템을 구축하여야 하는과제를 안게 되었다. 본고에서는 세월호 침몰사고와 관련하여 법정책적 관점에서 선박안전에 관한 법제의 문제점을 분석함과 아울러 선박안전관련 법제에 드러난 핵심적인 개선과제를 검토하기로 한다. 이와 관련하여 특히선박검사 대행제도가 안고 있는 문제점, 선장에 관한 공법적 권한 및 그 역할에 관한 제도개선의 방향,노후 선박에 대한 규제완화의 문제 및 안전운항에 대한 지도·감독과 관련한 자율규제의 문제에 대하여검토하기로 한다. 나아가 선박침몰 사고 후의 대응 및 재난관리시스템의 확보와 관련하여 「수난구호법」,「해사안전법」 및 「재난 및 안전관리기본법」의 문제점과 개선과제를 검토하기로 한다. 재해와 재난은 어느 시대, 어느 사회이건 다소 불가피하게 발생하는 측면이 있다. 하지만 법정책적인측면에서는 이와 같은 재해와 재난을 억제하는 사전예방적 노력이 필요하다. 나아가 재해와 재난이 다시금 발생한 경우에도 신속하고 효율적으로 대응하여 피해를 최소화하는 재난관리시스템을 구축하는것이 절실히 요청된다. 이와 같은 효율적인 재난관리시스템의 확보를 위하여 정부는 정부조직법을 개정하여 국무총리 소속하에 ‘국가안전처’를 두려고 하고 있는 바, 무엇보다도 국민의 안전이 우선시 되어야 하고 각 부처를 장악해야 하므로 재난 컨트롤 타워로는 부총리급을 수장으로 하는 이른바 ‘국민안전원’을 국무총리소속하에 두는 것이 바람직하다고 할 것이다. 이와 더불어 재난발생시 현장즉응력을높이는 구조시스템의 확보문제, 정부부처간의 협업의 효율성 확보와 민관협력시스템의 마련, 안전 및재난관련 법령의 통합 등 제반 개선과제를 모색하기로 한다.
Abstract
The continuing existence of modern society is threatened by a variety of dangercaused by the increasingly advanced and complex industrial structure today. As all kinds ofdisasters keep growing in size, they increase people’s anxiety with their lives and raise the level of their expected need for safety more than ever. The recent sinking accident of the passengership Sewol owned by Chonghaejin Marine Co., Ltd. and its dealing process demonstrated that theestablished legal systems around boat safety and disaster management were not simply working. This study analyzed legal problems with boat safety from the perspective of legal policies inrelation to the sinking accident of Sewol including the Ship Safety Act, Seafarers Act, ShipPersonnel Act, and Marine Transportation Act, as well as reviewed major improvement tasksrevealed in the legal systems related to ship safety. The study especially developed discussionsaround such issues as the problems with the agency of ship inspection system, directions for theinstitutional improvement of captains’ authority and roles in public law, mitigation of theregulations for aged ships, and voluntary control called guidance and supervision for safe sailing. Furthermore, the study delved into the problems with and improvement tasks of the Rescue andAid at Sea and in the River Act, Maritime Safety Act, and Act on the Management of Disastersand Safety with regard to responses after a ship sinking accident and the security of a disastermanagement system. Calamities and disasters inevitably happen to some degree regardless of times and society, butthere should be proactive and preventive efforts to control calamities and disasters from theperspective of legal policies. It is also a desperate need to set up a disaster management system tomake quick and efficient responses to calamities and disasters when they take place and minimizetheir damage. There is an attempt to establish a “Ministry of National Safety” under the supervision of theprime minister by revising the National Government Organization Act to secure such an efficientdisaster management system. It will be desirable that a “National Safety Board” is under thesupervision of the prime minister as a disaster control tower since it needs to make people’s safetythe top priority and take control over each ministry. The study also made suggestions for overallimprovement tasks including securing a relief system to enhance field readiness in case of disaster,efficiency of coordination among the government departments, establishment of a private-publiccooperation system, and Integration of disaster and safty legislation.
