크메르루즈 특별재판소 사례를 통해 본 통일 이후의 과거청산의 기본 방향에 대한 고찰

초록
나치 청산, 공산주의 청산, 군사독재 청산 등 20세기의 여러 나라의 체제불법에 대한 과거청산 사례를 살펴볼 때 공통적으로 알 수 있는 것은 많은 나라들이 과거청산을 통해 역사적 정의를 실현하기 위해 노력해왔다는 점과 스페인의 경우에서 알 수 있듯이 해당 시기에 여러 가지 이유로 제대로된 청산 없이 넘어가더라도 이 문제가 해결되는 것이 아니라 결국 수십 년이 흐른 후에도 과거청산의문제가 반드시 제기된다는 점이다. 따라서 남북통일 과정에서도 북한정권에 의해 수십 년간 행해진 체제불법에 대한 과거청산은 반드시필요하다. 다시 말해 과거청산은 국가가 지향하는 가치와 목적의 선포, 미래를 향한 결단 그리고 국민과 미래세대에 대하여 ‘무엇이 정의인지’에 대한 역사교육의 출발점으로서 큰 의미를 가지는 것이다. 그리고 가해자에 대한 사법적 단죄가 포함된 과거청산은 사회통합과 발전을 위한 필수적 전제라고 할수 있다. 특히 캄보디아의 경우 국민 정서가 지배층의 불의에 대해 둔감하며 정의에 대한 관심이 덜한 측면이있다는 점에서 크메르루즈 특별재판소(ECCC)의 존재는 국민인식을 전환시키는 역사교육기관으로 큰역할을 하고 있다고 평가되고 있다. 비록 최소한의 가해자에 의한 상징적 처벌이라는 ECCC의 한계 역시 분명하지만 장래 남북통일 당시 발생할 여러 정치적 상황 속에서 ECCC의 사례는 더 이상 물러설수 없는 최소한의 과거청산의 하나의 예로서 우리에게 시사점을 주고 있다.
Abstract
Viewing the many cases of transitional justice after Nazi-dictatorship, theEast-European communism and military dictatorship of the 20th century, we can find that manycountries tried to realize justice by bringing perpetrators to justice and that as knowing from theSpain case, oblivion is a not fundamental solution. Therefore, in the course of unification of South and North Korea, transitional justice in NorthKorea is positively necessary. In other words, transitional justice means the purpose of nation, the decision for the future andthe beginning of the history education to people especially young generation about what justice is. Bringing perpetrators to justice is essential point in the problem of transitional justice to achievesocial integration. Because there is a tendency that has no interest in the matter of justice in Cambodian, theECCC also well appreciated in that it played a important role of educational institution to makenational consciousness more sensitive to righteousness. Although the ECCC has a clear limitationsin that it is a just symbolic punishment to the very least perpetrators, there are some implicationsfor the Korea Unification and the transitional justice in North Korea as the Maginot Line of thepurge of the past.
