유엔아동권리협약에 비추어 본 청소년관련법 분석

초록
우리나라에서 청소년을 주 대상으로 하는 최초의 법은 1961년 미성년자보호법과 1962년 아동복리법이다. 이 법률의 성격은 미성년과 아동을 대상으로 보호에 국한된 수동적 법률 성격이었다. 이러한 한계를 극복하고자 제정된 것이 1987년 청소년육성법이었고, 국가발전적 차원에서 청소년을 육성하려는 법률적 성격을 가진것이 1991년 제정된 청소년기본법이다(김두현, 1994). 이어 청소년연구포럼(2003)에서 청소년기본법이 청소년 육성정책의 개념이나영역의 모호성, 청소년수련활동과 교류활동의 편중성, 중앙과 지방정책 연계성의 미흡, 청소년 직접참여를 위한 수준과 방법에 대한법적 근거 부재, 결정기능의 미약성, 평가 및 미래에 대한 비전의제시 부재 등으로 청소년기본법 개정과 청소년 관련법률 체계 정비의 필요성이 제기되었다(박부근, 이일용, 2004). 청소년관련법률의 선행연구에서도 이러한 논의들이 진행되었다(최충옥 외 2003; 현성수, 2003; 박부근, 이일용, 2004; 조영승, 2004;김윤나, 2006; 서수자, 2006). 그리고 유엔아동권리협약 제21조 '입양'의 유보에 관한 연구(김효진, 2009)나 아동인권 관련 국제조약이국내 아동복지제도에 미친 영향 연구(민진홍, 2011), 아동·청소년의권리에 관한 헌법적 연구(김연정, 2012) 등이 이루어졌으나, 아동복지에 관한 법률적 검토나 헌법에 기초한 분석, 혹은 유엔아동권리협약의 일부 조항에 관한 분석만이 이루어졌다.
Abstract
This study is the UN Convention on the Rights of the Child& Youth laws that try to analyze the limits and want to seekimprovement of the research done. In previous research byanalyzing the UN Convention on the Rights of the Child andYouth organize the contents of the applicable law, the UNConvention on the Rights of the Child in the provision ofinformation. And presented analysis in the framework of theBasic Law as a youth, Youth Activity Promotion, YouthProtection Act, protection of children and youth of Act, theYouth Welfare Act to ensure the level is divided into threequintile analysis. Study the contents of the UN Convention on the Rights of theChild does not fully reflect the juvenile laws, and also to ensurethat the contents reflect the level of the enemy. Nor collectivelyensure that the rights of adolescents to enforce the provisions ofthat Act, as well as qualified, may need to ensure effective havebeen raised. As a result, proposals have proposed six kinds of basic dataanalysis through these youth Korea's human rights and legal dimensions to determine the content of the deficiencies will needto be able to compensate. In this study for the futuredevelopment of youth human rights to move ahead in terms ofcontributing to a little bit of research will have significance. Key
