경계표에 대한 민사법적 보호방안에 관한 연구

초록
종래부터 토지의 경계설정은 매우 중요한 위치를 차지하였고, 현재 이러한 경계설정의 명확화를 위하여 2012년 3월 17일부터 토지의 실제 현황과 일치하지 아니하는 지적공부(地籍公簿)의 등록사항을 바로 잡고 종이에 구현된 지적(地籍)을 디지털 지적으로 전환함으로써 국토를 효율적으로 관리함과 아울러 국민의 재산권 보호에 기여함을 목적으로 「지적재조사에 관한 특별법」이 시행되고 있다. 최근 경계표와 관련하여서는 지적재조사와 관련하여 경계점표지등록부에 등록되는 경계점표지에 대해서는 별도의 타당한 수준의 효력 혹은 등기수준의 지위를 부여하고, 경계점표지등록부에 등록되는 표지 설치에 대해서는 국가에서 설치해 주고 등기비 수준이나 도근점설치비 수준의 별도의 등록경비를 받게 하는 것을 구상하고 있다. 또한 견해에 따라서는 민법을 근거로 한 법률상 경계개념인 지상경계 중심의 새로운 등록방법으로의 전환이 필요하다. 경계표는 유체물이고 민법상의 물건에 해당하므로, 물건에 대한 소유권 개념을 가지고 접근할 필요가 있다. 다만 경계표는 그 기능면에서 토지의 경계표는 토지의 경계와 관련하여 경계를 표시하는 기준이면서 법률적으로는 토지소유권의 범위를 설정하는 수단으로서의 기능을 수행한다는 특수성을 가지고 있다.
Abstract
The government established the Cadastral Resurvey Special Law in March 17th, 2012 as part of an effort to promote Efficient land use, and the protection of people’s ownership, by correcting wrong registrations in cadastral records, which do not match the actual status of land, and changing paper cadastre to digital format. In regard to Land Demarcation, the ideal idea is that government should take care of installing boundary Monuments for Cadastral Boundary Monument Registration System. However, Extra registration fee can be charged in similar level to registration fee or supplementary control point installation fee. Additionally, registration method needs to shifted toward ground boundary concept based on civil law. Boundary Monuments is Material object from Civil Law perspective. Thus, it needs to be approach from ownership standpoint. Boundary Monuments is placed on or near a boundary line to preserve and identify the location of the boundary line on the ground. In legal sense, it functions as tool for establishing boundary for land ownership.
