초록
보험은 동일한 종류의 사고를 당할 위험에 노출된 많은 사람들이 미리 보험료를 갹출해 공동자금을 형성하고 보험사고를 당한 자에게 보험금을 지급하는 제도이다. 보험계약은 사행계약성이 있으므로 계약을 체결하고자 하는 자는 신의성실의 원칙에 따라 고지하여야 한다. 보험계약중에서 가장 많은 분쟁사유가 고지의무와 관련된 부분이다. 특히 질문사항이 애매하거나 고지사항의 발생시기는 주요 분쟁대상이다. 고지의무는 보험계약자의 간접의무로서 이를 이행하지 않으면 불이익을 당하게 되므로 예상되는 위험을 측정하기 위해 중요 사항을 보험자에게 알려 불량위험을 배제하는 제도적 장치이다. 최근 보험계약의 고지의무에서 보험계약자와 피보험자의 중과실의 의미와 관련하여 판단기준, 고지의무의 정도, 과실에 따른 책임소재에 관한 의미 있는 판결이 있다. 동 판결은 중요한 사실의 존부를 알지 못하는 것을 중대한 과실을 판단하는 요소에 포함시키면서도 그러한 사실의 확인을 보험계약자가 이행하지 않은 것을 중대한 과실로 볼 수 없다고 판시하면서 고지의무를 수동적 답변의무로 해석하고 있다. 이에 대한 국내외 법률을 검토해 보고 대안을 제시해 본다.
Abstract
The contract of insurance is based upon the utmost good faith. In the korean commercial code § 651, a policyholder and the insured must disclosure all the material facts to the insurer before making an insurance contract. Where an insurance company or a person engaged in insurance solicitation persuades an ordinary policyholder to conclude an insurance contract, it shall explain significant matters prescribed by insurance contracts, such as a premium, scope of coverage, grounds for restricting the payment of insurance proceeds, and other relevant matters to an ordinary policyholder in an understandable manner. This paper studied the supreme court case(2011da54631). If the assured don't make disclosure, the insurer can avoid the contract. In major countries such as Germany, Japan and UK, they have changed a duty of disclosure since 2007. The lessons from other countries and legal issues arising the revision will be contribute to Korean insurance law reform. I think it is nice to convert from the duty of voluntary disclosure to the duty to answer question. I have focused on the § 651 of Korea commercial code concerning the duty of disclosure and evaluate the revision. I wish that this paper will help more information about duty of disclosure and make some solutions.
